In einer Klagebegründung taucht der Ausdruck "in the premises" wiederholt auf. Der bestehende KudoZ-Glossareintrag ist für diesen Fall nicht ganz befriedigend.

O-Ton:
"In the premises, pursuant to section 104(2) of the CDPA, Mr Musicman shall be presumed to have been the author of the composition Coo! Coo! and to have written the composition on his own account.

Köönte mir aber vorstellen, dass in diesem spreziellen Falle (da es ja nicht um eine schriftliche Beweisaufnahme oder so etwas geht) auch "auf Grund der Sachlage" als Übersetzun in Frage kommt. Muß man aber im größeren Kontext entscheiden.

Explanation:
2) in legal pleading, premises means "all that has hereinabove been stated," as in a prayer (request) at the end of a complaint asking for "any further order deemed proper in the premises" (an order based on what has been stated in the complaint.)

AMM thinks ‘these premises’ means ‘this contract’, whereas I think it means ‘the recitals above’. It’s possible to find support for my opinion, but not much.

The word premises is sometimes used in the sense of matters (usu. preliminary facts of statements) previously referred to in the same instrument. In practice, this usage is often inarticulate and confusing, since the subject matter constituting the premises is rarely specified in the instrument.

Well, all I can say is that I'm quite mystified. Even Words and Phrases Legally Defined only gives two meanings: 1) land and buildings and 2) things before mentioned.
