In the case of Vendors taking charge of part or all transport between Vendor factory or warehouse and XXXX’s Forwarder, Place of Discharge, XXXX warehouses or XXXX stores, Vendors commit to have their transporters respect the maintenance of temperatures imposed by the laws and rules, both national and international, for every type of fresh and frozen foodstuffs, during the entire transport of said products.
Upon reception of fresh or frozen foodstuffs, XXXX stores and warehouses reserve the right to effect all controls relative to the respect of regulation temperatures.
In case of said controls revealing a serious defect or fault, Vendors’ merchandise can be refused, marked as non-consistent and therefore, be destroyed and/or returned to Vendors for destruction thereof, at Vendors’ complete charge, since it will not be commercialised by XXXX.
