Contracted out
This refers to a statutory arrangement under which pension schemes that meet certain conditions may contract out of the second state pension (S2P), formerly the state earnings related pension (SERPS), and the members and employers pay lower National Insurance contributions. Members of a contracted out pension scheme obtain rights in the pension scheme in place of additional earnings - related benefits under the state scheme.
Estas questões foram suscitadas no âmbito de um litÃgio que opõe M. T. Magorrian e I. P. Cunningham ao Eastern Health and Social Services Board e ao Department of Health and Social Services a respeito de certas prestações complementares de um regime de pensões de velhice convencionalmente excluÃdo.
Ambas as recorrentes na causa principal estavam inscritas no e pagavam cotizações para o Health and Personal Social Services Superannuation Scheme (a seguir «Superannuation Scheme»), que é um regime voluntário de pensão convencionalmente excluÃdo para o qual contribuem tanto a entidade patronal como os trabalhadores. Desde 1973, a inscrição neste regime é possÃvel para os trabalhadores a tempo parcial cujo horário atinja um determinado número de horas e, desde 1991, para todo o pessoal a tempo parcial, independentemente do número de horas prestadas. Nos termos deste regime, os inscritos recebem uma quantia fixa no momento da aposentação e seguidamente pagamentos mensais.
