Flemish term or phrase: akte van rechtspleging
In een vonnis (Belgische rechtbank van koophandel) staat het volgende:

"Art. 1700 B.W. vereist dat het moet gaan om een betwist recht, conform de interpretatie van het Hof van Cassatie betekent dit dat er een procedure aanhangig moet zijn voor de overdracht van het recht en de betwisting over het recht zelf moet zijn opgeworpen in de *akte van rechtspleging*."

Een definitie van de term "akte van rechtspleging" die ik gevonden heb luidt als volgt:
‘een akte in het kader van een gerechtelijke procedure of onder controle van het gerecht, uitgaande van de partijen, hun mandatarissen of de medewerkers van de rechter’
