Dans le langage de la procédure judiciaire, l' " intimé " désigne le défendeur à l'instance d'appel.L'intimé auquel le tribunal de première instance n'a pas reconnu l'ensemble des prétentions qu'il a fait valoir devant cette juridiction , peut saisir la Cour d' un appel incident .Il peut être formé en tout état de cause .Cette voie de réformation est recevable bien que ,le jugement de première instance ayant été signifié à l'intéressé,l'auteur de l'appel incident ne serait plus dans les délai pour faire un appel principal.Dans ce cas, s'agissant d'une procédure liée à l' appel principal ,la recevabilité de l'appel incident reste subordonnée à la validité de l'appel principal.

A party who files an appeal is called an appellant or petitioner, and a party on the other side is called a respondent (in most common-law countries) or an appellee (in the United States). A cross-appeal is an appeal brought by the respondent. For example, suppose at trial the judge found for the plaintiff and ordered the defendant to pay $50,000. If the defendant files an appeal arguing that he should not have to pay any money, then the plaintiff might file a cross-appeal arguing that the defendant should have to pay $200,000 instead of $50,000.
