Tanto la LP como el CPE se refieren expresamente al "experto en la materia" o al "experto sobre la materia" en los articulos que definen el requisito de actividad inventiva (Art. 8.1 de la LP y Art. 56 del CPE) y el requisito de suficiencia de la descripcion (Art. 25.1 y 112.1 de la LP y Art. 83, 100 y 138 del CPE). Las citadas leyes no definen explicitamente el concepto de "experto en la materia", aunque si lo hace la doctrina de las ***Camaras de recursos*** de la OEP.
