La Garantie "Remboursement par Avoir" pour téléviseur à écran plat comprend les prestations d'extension de garantie dans leur étendue et leur durée, l'assistance téléphonique ainsi que la reprise de l'appareil en 6è et 7è années, dans les conditions définies ci-après.
14.2.1 - Définitions
Appareil garanti : téléviseur à écran LCD ou téléviseur à écran Plasma, dénommé "le téléviseur" pour lequel le client a souscrit la garantie "Remboursement par Avoir" et dont la garantie contractuelle, au moment de l'achat, est égale ou supérieure à 2 ans. Panne : Problème d'origine interne, constaté par XXXXXX, entravant le bon fonctionnement du téléviseur et nécessitant le remplacement d'une ou plusieurs pièces détachées.
Certains éléments consomptibles, comme par exemple les fusibles, ne sont pas considérés comme pièces détachées (voir art. 14.2.7 Exclusions de la garantie "Remboursement par Avoir"). Remboursement de l'appareil : Avoir d'un montant égal au prix effectivement payé par le client lors de l'achat du téléviseur faisant l'objet de la présente garantie. Cet Avoir est à valoir sur l'achat d'un téléviseur de remplacement.
14.2.2 - La garantie "Remboursement par Avoir"
- La souscription de la garantie couvre le remboursement, par Avoir, du téléviseur garanti, en cas de panne constatée par XXXXXX.. Cet Avoir est à valoir sur l'achat d'un téléviseur de remplacement dans un délai maximum de 3 mois à compter de sa délivrance. - Les interventions ne nécessitant pas le remplacement de pièce détachée (exemple : soudure) sont prises en charge par par la présente garantie sans pour autant donner droit à un remboursement par Avoir du téléviseur et sous réserves des exclusions reprises à l'article 14.2.7 ci-après.
- Si le prix du téléviseur de remplacement est inférieur au montant de l'Avoir, le client aura la possibilité d'utiliser le solde de cet Avoir pour tout autre achat. En cas de panne constatée sur ce nouveau téléviseur, l'Avoir de remboursement sera égal au prix de ce nouveau téléviseur. - L'Avoir doit être utilisé en une seule fois. Tout ou partie de l'Avoir non utilisé sera perdu et ne pourra donner lieu à un remboursement en espèces. - Si le prix du téléviseur de remplacement choisi par le client est supérieur au montant de l'Avoir, le client devra payer la différence, par tout moyen de paiement accepté par XXXXXX. Si le nouveau téléviseur devait, lui aussi, être remboursé par Avoir suite à panne, le nouvel Avoir émis serait plafonné au prix du téléviseur initial, objet de la souscription de la présente garantie.
- Si le téléviseur de remplacement choisi par le client ne bénéficie que d'une garantie contractuelle d'un an, la durée de la garantie "Remboursement par Avoir" se limitera à 3 ans au total, à compter de l'achat du téléviseur initial, objet de la souscription de la présente garantie. - L'application de la garantie est subordonnée à la présentation de la facture d'achat et à la communication du numéro de série de l'appareil par le client. - La garantie n'est en aucun cas cessible.
- Seuls les services XXXXXX sont habilités à faire appliquer la présente garantie. - Sur demande écrite du client, le téléviseur pourra être réparé plutôt que remboursé par Avoir, à la condition que la réparation s'avère techniquement possible et économiquement raisonnable (c'est-à-dire, coût de la réparation inférieur à la valeur vénale résiduelle du téléviseur) pour les services XXXXXX et à la condition que la panne entre bien dans le cadre de la garantie sous réserve des exclusions reprises à l'article 14.2.7.
14.2.3 - Effet et durée des garanties
14.2.3.1- La durée de la garantie est de 5 ans au total et prend effet dès le jour de la délivrance du téléviseur, sous réserve du paiement de la cotisation correspondante. La souscription de la présente garantie doit donc se faire au moment de l'achat du téléviseur. 14.2.3.2- En cas de remboursement par Avoir du téléviseur suite à panne, la durée de garantie restant à courir sera reportée sur le téléviseur de remplacement choisi par le client sauf exception visée au point 13.2.3.4 ci-dessous. 14.2.3.3- La durée de garantie ne pourra être prolongée au delà de 5 ans à compter de la délivrance du premier téléviseur ayant fait l'objet de la souscription de la présente garantie. 14.2.3.4- Si le téléviseur de remplacement choisi par le client ne bénéficie que d'une garantie contractuelle d'un an, la durée de la garantie "Remboursement par Avoir" se limitera à 3 ans au total, à compter de l'achat du téléviseur initial, objet de la souscription de la présente garantie. 14.2.3.5- A compter du remboursement par Avoir du téléviseur, le client dispose de 3 mois maximum pour choisir son nouveau téléviseur sans que ce délai ne puisse prolonger la durée de la présente garantie.
14.2.4 - L'assistance téléphonique
La garantie permet un accès à l'assistance téléphonique XXXXXX pendant 5 ans, sauf exception visée au point 14.2.3.4 ci-dessus. Le numéro d'appel ainsi que le numéro de contrat d'assistance figurent sur la facture du client. La prestation couvre : - le conseil sur l'installation et la mise en service du téléviseur, - le conseil sur l'utilisation du téléviseur,
- le pré-diagnostic en cas de panne. En cas de panne, l'appel à l'assistance téléphonique est obligatoire avant toute autre action. Ce service d'assistance est disponible 7 jours sur 7 (sauf jours fériés) de 8 h à 22 h du lundi au samedi et de 10 h à 20 h le dimanche.
14.2.5 - Conditions de reprise en 6è et 7è années
A l'expiration de la période de garantie de 5 ans et pendant 2 ans, si le client achète un appareil de remplacement avec souscription d'une nouvelle garantie, XXXXXX lui proposera de reprendre son téléviseur pour 20% de sa valeur (prix payé), dans la limite toutefois de 20% du prix du nouveau téléviseur.
14.2.6 - Cotisation
Le montant de la cotisation apparaît sur la facture du téléviseur garanti et fait foi de la souscription, par le client, de la présente garantie.
14.2.7 - Exclusions de la garantie "Remboursement par Avoir"
NE SONT PAS COUVERTS : - Les dommages engageant la responsabilité d'un tiers ou résultant d'une faute intentionnelle ou dolosive. - Les dommages résultant de négligences, d'utilisation d'énergie, d'emploi ou d'installation non conformes aux prescriptions du constructeur. - Le remplacement d'un élément consomptible (exemple: fusible), d'une pièce de présentation n'entravant pas le bon fonctionnement du téléviseur ou la mise à jour du logiciel interne. - Les dommages résultant d'une oxydation. - Les pannes dues à l'antenne ou à une mauvaise réception, les erreurs de branchements ou de mise en service. - Les dommages résultant d'une utilisation industrielle ou commerciale. - Les dommages résultant d'une cause externe comme le choc, la chute, la foudre, l'incendie, la tempête, le vandalisme. - Les dommages matériels ou immatériels consécutifs à une panne du téléviseur (trouble de jouissance...) Les dispositions ci-dessus ne peuvent en aucun cas réduire ou supprimer : - la garantie légale (art. L.211-1 et suivants du code de la consommation et art.1641 et suivants du code civil) - la garantie contractuelle du constructeur, si elle existe (voir bon de garantie)
14.2.8 - Procédure en cas de panne
- En cas d'impossibilité de dépannage par téléphone, l'Assistance téléphonique missionnera un technicien qui prendra rendez-vous avec le client pour vérifier l'existence de la panne. - Si la panne est constatée, le technicien préviendra les services XXXXXX afin qu'un Avoir soit mis le plus rapidement possible à la disposition du client.
Seuls la mention "Garantie Remboursement par Avoir" et son tarif correspondant, mentionnés sur la facture du Client, font foi de la souscription de la présente garantie.
- Le client doit obligatoirement appeler l'Assistance téléphonique XXXXXX au numéro repris sur sa facture et lui communiquer son numéro de contrat de garantie également repris sur sa facture.
14.2.9 - Territorialité
La présente garantie "Remboursement par Avoir" s'applique sans frais de déplacement dans un rayon de 30 Km autour des points de ventes physiques XXXXXX. Au delà de ce rayon et dans une limite d'intervention de 80 km, les kilomètres supplémentaires seront facturés au tarif en vigueur. Au delà des 80 km, le client devra obligatoirement apporter son téléviseur au magasin ou SAV désigné par l'assistance téléphonique XXXXXX.
14.2.10 - Cessation de la garantie
La garantie "Remboursement par Avoir" prend fin :
- A l'expiration de la période de garantie telle que définie à l'article 14.2.3 ci-avant. - En cas de disparition ou destruction totale du téléviseur n'entraînant pas la mise en jeu de la présente garantie. - En cas de demande écrite du client suite à son déménagement au delà de 80 km autour d'un magasin ou centre de services XXXXXX. Dans ce cas, XXXXXX remboursera la cotisation perçue au prorata temporis des mois restant à couvrir, déduction faite de 15% pour frais de dossier. Pour ce faire, le client remettra sa facture d'achat et un justificatif de domicile. - Dans le cas où le client souhaite souscrire une nouvelle garantie "Remboursement par Avoir" sur le téléviseur obtenu par Avoir dans le cadre de la présente garantie, il pourra mettre fin à ladite garantie en cours. Il devra à cet effet adresser sa demande écrite à XXXXXX accompagnée de sa facture d'achat d'origine et de la nouvelle facture. XXXXXX lui remboursera alors la cotisation perçue au prorata temporis des mois restant à couvrir, déduction faite de 15% pour frais de dossier.
Translation - English ARTICLE 14.2 FIVE-YEAR “CREDIT COMPENSATION” GUARANTEE FOR FLAT-SCREEN TELEVISION SET
The “credit compensation” guarantee for flat-screen television set provides for the extension of the guarantee, both in the meaning and in the period thereof, as well as telephone assistance, and trade-in of the appliance during the sixth and seventh years, in accordance with the provisions below.
14.2.1- Definitions
Guaranteed appliance: an LCD-screen television set or plasma-screen television set, referred to as “the television set”, for which the customer has taken out a “credit compensation” guarantee, and for which the commercial guarantee, at the time of purchase, is equal to or greater than two years. Malfunction: A problem, of internal origin, verified by XXXXXX, negatively affecting the proper functioning of the television set and necessitating the replacement of one or more spare parts.
Certain consumable components, such as fuses, for example, are not considered as spare parts (see Art. 14.2.7: Exclusions from the “credit compensation guarantee”). Compensation for the appliance: Credit of an amount equal to the actual price paid by the customer at the time of purchase of the television set subject to this guarantee. This credit is to be applied to the purchase of a replacement television set.
14.2.2. – The “credit compensation” guarantee
- The guarantee covers compensation, in the form of credit, for the television set under guarantee, in the event of a malfunction verified by XXXXXX. This credit is to be applied to the purchase of a replacement television set within a maximum period of three months from the date on which it is awarded. - Servicing operations not requiring the replacement of a spare part (e.g. soldering) are covered under this guarantee, without such operations giving rise to an entitlement to credit compensation for the television set, and with the exceptions set down in Article 14.2.7 below.
- If the price of the replacement television set is less than the amount of the credit, then the customer shall have the right to use the remaining balance of such credit for any other purchase. In the event that a malfunction occurs in this new television set, the refunded credit shall be equal to the price of the new television set. - The credit may be used only once. Credit not used, either in its entirety or in part, shall be forfeited, and shall not give rise to any entitlement to a refund in cash. - If the price of the replacement television set chosen by the customer is greater than the amount of the credit, the customer shall pay the difference, by any means of payment accepted by XXXXXX. If compensation is required for the new television set itself subsequent to a malfunction thereof, the new credit given shall be capped at the price of the initial television set covered under this guarantee.
- If the replacement television set chosen by the customer is guaranteed under contract for one year only, the term of the “credit compensation” guarantee shall be limited to three years in total, starting from the date of purchase of the initial television set covered under this guarantee agreement. - Exercise of the guarantee is subject to the presentation of the purchase invoice and to the provision of the serial number of the appliance by the customer. - The guarantee is under no circumstances transferable.
- Only the operational departments of XXXXXX are authorised to implement this guarantee. - At the written request of the customer, the television set may be repaired, rather than being made subject to compensation by credit, on the condition that the repair is technically feasible and economically reasonable (that is to say, the cost of the repair is lower than the residual monetary value of the television set) for the operational departments of XXXXXX, and on the condition that the malfunction falls within the scope of the guarantee, subject to the exclusions set down in Article 14.2.7.
14.2.3 – VALIDITY AND TERM OF GUARANTEES
14.2.3.1- The term of the guarantee is five years in total, and shall take effect from the date of transfer of possession of the television set, subject to payment of the fee. This guarantee must be taken out at the time of purchase of the television set. 14.2.3.2- In the event of compensation by credit for the television set subsequent to a malfunction thereof, the remainder of the term of the guarantee shall be transferred to the replacement television set chosen by the customer, except as stipulated in point 13.2.3.4 below. 14.2.3.3- The term of the guarantee cannot be extended beyond five years from the date of transfer of possession of the initial television set subject to this guarantee. 14.2.3.4- If the replacement television set chosen by the customer is guaranteed under contract for one year only, the term of the “credit compensation” guarantee shall be limited to three years in total, starting from the date of purchase of the initial television set covered by this guarantee agreement. 14.2.3.5- Starting from the date of award of compensation credit for the television set, the customer shall have a maximum of three months to choose a new television set, without that period giving rise to an extension in the term of this guarantee.
14.2.4- Telephone help centre
The guarantee shall allow for access to the XXXXXX telephone help service for a period of five years, except under the conditions set down in point 14.2.3.4 above. The number to call and the assistance agreement number are shown on the customer invoice. The service covers: - advice on the installation and setting in operation of the television set, - advice on using the television set,
- preliminary diagnostic check in the event of a malfunction. In the event of a malfunction, it is a requirement that the customer call the telephone help service prior to taking any other action. This help service is available seven days a week (except public holidays), from 8 a.m. to 10 p.m. Monday to Saturday, and from 10 a.m. to 8 p.m. on Sundays.
14.2.5- Conditions for trade-in during sixth and seventh years
On expiry of the five-year guarantee period and for the following two years, if the customer purchases a replacement appliance and takes out a new guarantee, XXXXXX shall offer to accept the television set as a trade-in, for 20% of its value (price paid), up to a maximum limit, however, of 20% of the price of the new television set.
14.2.6. Fee
The amount of the fee is shown on the invoice for the guaranteed television set and constitutes proof that the customer is covered under the guarantee.
14.2.7 – Exclusions from the “compensation credit” guarantee
THE FOLLOWING ARE NOT COVERED: - Damage arising under the liability of a third party, or resulting from wrongful use or intentional misuse. - Damage due to negligence, or due to the use of energy, to the use for a purpose, or to installation that is not in accordance with the specifications set down by the manufacturer. - The replacement of consumable components (e.g. fuses), of a decorative part that does not affect proper functioning of the television set, or the updating of internal software. - Damage due to oxidation. - Antenna problems or poor reception, incorrect connection to utility networks or placement in operation. - Damage due to industrial or commercial use. - Damage resulting from an external cause such as shock, fall, flood, fire, adverse weather, vandalism. - Material and immaterial damage resulting from the malfunction of the television set (prevention of enjoyment, etc.). The provisions above shall in no case limit or invalidate: - The legal guarantee (Art. L.211-1 and following of the Consumer Code and Art. 1641 and following of the Civil Code)
- Manufacturer’s commercial guarantee, if any (see guarantee slip).
14.2.8 – Procedure in the event of a malfunction
- In the event that the malfunction cannot be resolved over the telephone, the telephone help centre will dispatch a technician, who will meet with the customer in order to verify the malfunction. - If the malfunction is verified, the technician will advise XXXXXX's operating departments so that a credit may be made available to the customer as quickly as possible.
The wording “Garantie Remboursement par Avoir” and the corresponding charge amount, displayed on the customer invoice, are the sole indication that this guarantee has been entered into.
- The customer is required to call the XXXXXX telephone help centre at the number shown on the invoice, and provide the guarantee agreement number, which is also shown on the invoice.
14.2.9 – Territorial application
This “compensation credit” guarantee shall apply without call-out costs within a radius of 30 km of physical XXXXXX points of sale. Beyond this radius and up to a service call-out distance limit of 80 km, additional kilometres will be invoiced at the rate in effect. Beyond 80 km, the customer shall be required to transport the guaranteed appliance to the store or after-sales service centre designated by the XXXXXX telephone assistance centre.
14.2.10 – Termination of the guarantee
The “credit compensation” guarantee shall cease effect:
- On expiry of the guarantee period as set down in Art. 14.2.3. above. - In the event of total destruction or loss of the television set, such as does not give rise to the exercise of the “credit compensation” guarantee. - In the case of a written request from the customer following a change of address to a location more than 80 km from a XXXXXX store or service centre. In this case, XXXXXX will refund the fee received on a prorata temporis basis for the number of months left to run on the guarantee, less a deduction of 15% for filing costs. In order for this to happen, the customer must forward the purchase invoice and proof of address. - In the event that the customer wishes to take out a new “credit compensation” guarantee on a television set obtained using credit under this guarantee, the customer may cancel the guarantee currently in effect. The customer shall for this purpose forward its request in writing to XXXXXX, enclosing the original purchase invoice and the new invoice. XXXXXX shall then refund the fee received on a prorata temporis basis for the number of months left to run on the guarantee, less a deduction of 15% for filing costs.
