Dieser Auffassung des Oberlandesgerichts wurde durch den Beschwerdeführer schrift-sätzlich mehrfach widersprochen (Schriftsätze vom 18.06.2002 und vom 03.07.2002), denn der Beschwerdeführer hatte ausdrücklich bereits in diesem Verfahren, z. B. mit Schriftsatz vom 14.06.2000 u. a. beantragt, der Mutter sowohl das Aufenthaltsbestimmungsrecht als auch die Rechtsausübung betreffend den Umgang zu entziehen. Ausschließlich der Standpunkt des Gerichtes machte das im Jahr 2001 durch den Beschwerdeführer zusätzlich am Amtsgericht eröffnete Sorgerechtsverfahren notwendig. Das Oberlandesgericht beendete das im Juli 1999 eröffnete Verfahren, in dem es dem Beschwerdeführer ein Umgangsrecht eingeräumt hat (Beschluss vom 03.09.2002, Az. 1 UF 103/00), welches allerdings nur auf dem Papier stand, weil es nicht durchsetzbar war. Alle weiteren, sorgerechtlichen Anträge des Beschwerdeführers wurden nicht behandelt. Hätte der Beschwerdeführer nun gegen diese Entscheidung die Verfassungsbeschwerde erhoben, wäre er auf die fehlende Ausschöpfung des Rechtswegs verwiesen worden. | Translation - English
The Higher Regional Court’s stance was repeatedly objected to in writing by the appellant (written submissions of 18th June 2002 and 3rd July 2002), as the appellant had already requested, amongst other things, e.g., by written submission of 14th June 2000, that the mother’s right to determine the place of abode as well as the exercise of the right with regards to access be revoked. The additional custody proceedings, which the appellant was required to initiate before the Local Court in 2001, can exclusively be attributed to this position of the Court. The Higher Regional Court concluded the proceedings initiated in July 1999, by granting the appellant a right of access (decision of 3rd September 2002, Az. 1 UF 103/00), which, however, only existed on paper, as it was not enforceable. All further applications regarding custody on the part of the appellant were not addressed. If the appellant had lodged the constitutional complaint against this decision, he would have been informed that his rights of appeal had not been exhausted. |

Ende Juni 2007 hat die Bundesrepublik Deutschland die EU-Ratspräsidentschaft an Portugal weitergegeben. Kurz vor dem Ende der deutschen Präsidentschaft besuchten die Spitzenvertreter der europäischen Wirtschaftsvereinigung BUSINESSEUROPE die Bundeshauptstadt Berlin. Die Präsidenten europäischer Industrie- und Arbeitgeberverbände kamen auf Einladung des Bundesverbandes der Deutschen Arbeitgeberverbände (BDA) zusammen. Unter der Leitung von BUSINESSEUROPE-Präsident Ernest-Antoine Seillière diskutierten die Präsidenten unter anderem die Themen Energie und Klimawandel, das G8 Gipfeltreffen und die transatlantische Agenda. In ihrem Grundsatzreferat benannte Bundeskanzlerin Angela Merkel die Herausforderungen der deutschen Ratspräsidentschaft und erläuterte die Ergebnisse. | Translation - English
At the end of June 2007, Germany passed the Presidency of the EU Council to Portugal.Shortly before the German presidency came to an end, the top representatives of the European
business association BUSINESSEUROPE met in the German capital of Berlin. The presidents of European industrial and employers’ associations gathered at the invitation of the Federation of German Industries (BDI) and the Confederation of German Employers’ Associations.
Under the direction of BUSINESSEUROPE’s President, Ernest-Antoine Seillière, the presidents, among other topics, discussed energy and climate change, the G8 summit meeting and the Transatlantic Agenda. In her keynote speech, Chancellor Angela Merkel pointed out the challenges of Germany’s EU Council Presidency and characterised the results.
