COMMENTS OF THE
TRUCK AND ENGINE MANUFACTURERS ASSOCIATION
I. Introduction
The Truck and Engine Manufacturers Association (“EMA”) hereby submits its comments on the Draft Bill for the Regulation of Emissions from Non-Road Mobile Machinery, as proposed by The Republic of Chile Ministry of the Environment (the “Current Proposal”). The Republic of Chile Ministry of the Environment (“Chile”) approved the Current Proposal on October 26, 2016 as Exempt Resolution No. 1134. It appeared in the Diario Oficial on November 8, 2016.
EMA represents the world’s leading manufacturers of internal combustion engines and commercial motor vehicles. EMA’s members conduct business throughout the world, including Chile. (A complete list of EMA’s members is included as Attachment A). Included in the broad array of engines produced by EMA’s members are the various sizes of engines used in non-road mobile machinery, the applications affected by the Current Proposal.
EMA arranged to have the approval communication and the Diario Oficial notice translated into English. It is the translated English version of those two documents on which EMA is basing its comments. We believe that they are faithful translations of the original Spanish versions of those documents, but as there may be issues that arise in the course of the translation, a copy of the English versions of those documents is included with these comments for reference purposes, as Attachments B and C.
III. Summary of the Current Proposal
The Proposal of 5Jan16 and the Proposal of 26Oct16 include provisions that pertain to engines used in certain on-highway, stationary and nonroad applications. The Current Proposal pertains only to the latter regulatory category: engines used in nonroad applications. Below is a summary of the Current Proposal.
Geographic Scope – The geographic scope of both the Proposal of 5Jan16 and the Proposal of 26Oct16 is the Metropolitan Region of Santiago. The geographic scope of the Current Proposal is the entire country of Chile.
Scope – Engine Types – In both the Proposal of 5Jan16 and the Proposal of 26Oct16 only compression ignition (“CI”) engines used in nonroad applications are included. The Current Proposal expands the scope to include spark ignited (“SI”) engine types.
Scope – Imported Versus Domestically-Produced New Non-Road Mobile Machinery – The Current Proposal calls for new non-road mobile machinery to comply with the first phase of standards beginning January, 2019 and the second phase of standards beginning January, 2022. The Current Proposal goes on to define new non-road mobile machinery as that which enters the country as of those dates.
Scope – Transportable Applications – In both the Proposal of 5Jan16 and the Proposal of 26Oct16 it is unclear as to whether engines used in transportable applications are included within the scope. The Current Proposal makes it clear that such engines are included.
First Phase of Standards – Lead-time – As in the Proposal of 5Jan16 and the Proposal of 26Oct16, the Current Proposal calls for the first phase of standards to become effective January, 2019.
First Phase of Standards – Numerical Limits – Just as in the Proposal of 5Jan16 and the Proposal of 26Oct16, the Current Proposal includes two phases of standards. Similar to the Proposal of 5Jan16 and the Proposal of 26Oct16, the first phase of proposed standards is aligned with the Stage IIIA standards of Europe and the Tier 3 standards of the U.S.
Second Phase of Standards – Period of Stability – Just as in the proposals of 5Jan16 and 26Oct16, Chile proposes an effect date of January, 2019 for the first phase of standards, and January, 2022 for the second phase of standards in the Current Proposal, providing a three year period of stability between phases.

COMENTARIOS DE LA ASOCIACIÓN DE FABRICANTES DE CAMIONES Y MOTORES
I. Introducción
La Asociación de fabricantes de camiones y motores (“EMA”) envía por la presente sus comentarios respecto del Proyecto de ley para la regulación de emisiones de máquinas móviles que no han de ser utilizadas en la carretera, propuesto por el Ministerio del Medioambiente de la República de Chile (la “Propuesta actual”). El Ministerio del Medioambiente de la República de Chile (“Chile”) aprobó la Propuesta actual el 26 de octubre del 2016, a través de la Resolución exenta N. º 1134. Fue publicada en el Diario Oficial el 8 de noviembre del 2016.
EMA representa a los fabricantes de motores de combustión interna y vehículos con motores comerciales más importantes del mundo. Los miembros de EMA realizan transacciones comerciales en todo el mundo, incluso en Chile (ver la lista completa de los miembros de EMA en el Adjunto A). Dentro de la amplia variedad de motores fabricados por los miembros de EMA, se encuentran los motores de distintos tamaños utilizados en máquinas móviles de no carretera, cuyo uso se ve afectado por la Propuesta actual.
EMA dispuso que se tradujera a inglés el documento de aprobación y su correspondiente publicación en el Diario Oficial. En función de las versiones traducidas al inglés de dichos documentos, EMA basó sus comentarios. Se ha asumido que las traducciones son fieles al contenido en español, pero por si hubiera diferencias entre original y traducción, se ha adjuntado a este documento una copia de las versiones en inglés para tener como referencia, en los Adjuntos B y C. III. Resumen de la Propuesta actual
La Propuesta del 5/ENE/16 y la Propuesta del 26/OCT/16 incluyen cláusulas que afectan a motores de carreteras, estacionarios y no de carreteras. La Propuesta actual solo afecta a la última categoría: motores no de carreteras. A continuación se incluye un resumen de la Propuesta actual.
Alcance geográfico: el alcance geográfico tanto de la Propuesta del 5/ENE/16 y del 26/OCT/16 es la Región Metropolitana de Santiago. El alcance geográfico de la propuesta actual es todo Chile.
Alcance – tipos de motores: tanto en la Propuesta del 5/ENE/16 como en la del 26/OCT/16 solo los motores encendidos por compresión (“CI”) para máquinas móviles de no carretera están incluidos. La Propuesta actual expande el alcance para incluir también a los motores encendidos por chispa (“SI”).
Alcance – máquinas nuevas móviles de no carretera importadas versus máquinas fabricadas en el país: La Propuesta actual exige que las máquinas móviles de no carretera cumplan la primera fase de las normas a partir de enero del 2019, y la segunda fase a partir del 22 de enero del 2022. La Propuesta actual define a las máquinas móviles nuevas de no carretera como aquellas que ingresan al país a partir de las fechas antes especificadas.
Alcance – fines de transportación: tanto en la Propuesta del 5/ENE/16 como en la del 26/OCT/16 no queda claro si los motores utilizados para fines de transportación están incluidos. La Propuesta actual deja en claro que dichos motores están incluidos.
Primera fase de las normas – tiempo de espera: al igual que en la Propuesta del 5/ENE/16 y en la del 26/OCT/16, la Propuesta actual exige que la primera fase de las normas entre en vigencia en enero del 2019.
Primera fase de las normas – límites numéricos: al igual que en la Propuesta del 5/ENE/16 y en la del 26/OCT/16, la Propuesta actual incluye dos fases de normativas. Similar a la Propuesta del 5/ENE/16 y a la del 26/OCT/16, la primera fase de las normas propuestas se alinea a la Fase IIIA de los Estándares de Europa y el plan Tier III de los Estándares de Estados Unidos.
