On this 1st day of September 2003, corresponding to the ____ day of ____ 14__A.H. in the city of ____, Hashemite Kingdom of Jordan, this lease is made between:
1. _________________, Jordanian national possessing national identity card No. _____________ issued in the city of _________, on ________, businessman by profession, whose address is P.O. Box ____, ____ ____, The Hashemite Kingdom of Jordan (hereinafter referred to as the “Lessor”); and
2. Construction Company for Trading & Investment, a Jordanian company with commercial registration number ______, having in address at P.O. Box ____, ____ ____, Hashemite Kingdom of Jordan, and represented for the purposes of entering this lease by Waleed Al Soyouti, Jordanian national bearing national identity card number _____, issued in the city of on (hereinafter referred to as the “Lessee”).
The Lessor and the Lessee hereby agree to the following:
1. The Lessor hereby leases to the Lessee, and the Lessee hereby accepts the lease of, the building, land, and appurtenances commonly known as and located at (hereinafter referred to as the “Building”).
2. The Lessor leases the Building to the Lessee for an initial term of five Gregorian years beginning on September 1, 2003, and ending on August 2008S. At the termination of the lease, the Lessee has the option of extending the lease for two similar terms of five years each on the same terms and conditions as set forth in this lease.
3. In consideration of the Lessor leasing the Building to the Lessee, the Lessee shall pay to the Lessor rent for the first year in the amount of JD 32,000, which will cover the period from September 1, 2003 to August 31, 2004. For the period beginning on September 1, 2004 and ending on August 31, 2005, the rent will be JD 34,000, paid in full no later than the first day of the corresponding lease term. For after August 31, 2001 the rent will increase annually by three percent (3%).
4. The first year’s rent will not be refundable even in the event that the Lessee cannot obtain the necessary permits to carry on the business for which he intended to rent the Building.
5. The Lessee intends to use and occupy the Building as a car showroom and car service shop pursuant to permits to be obtained from the Municipality of ____.
6. The Lessee shall pay rent to the Lessor at the Lessor’s above stated address or at such other places the Lessor may designate in writing without demand, and without counterclaim, deduction, or setoff 'of any kind.
7. The Lessee undertakes to provide the Lessor with copies of all official permits the Lessee obtains from the Jordanian government to conduct the Lessee's intended business.
8. Upon receipt from the Lessee of a check in the amount of the first year’s rent and execution of this contract by the Lessee and the Lessor, the Lessor will hand over to the Lessee the key to the Building so that the Lessee can begin construction and alteration work on the Building. The, Lessee’s occupation of and work on the Building prior to September 2003 shall be at no cost to Lessee.
9. The Lessee shall commit no act of waste and shall take good care of the Building and the fixtures and appurtenances thereto and, in the use and occupancy of the Building, shall conform to all relevant laws, orders and regulations of the Jordanian government.
10. All improvements made by the Lessee to the Building which are so attached to the Building that they cannot be removed without causing material injury to the Building shall become the property of the Lessor upon termination of this lease.
11. Upon termination of this lease, the Lessee shall, at the Lessee’s own expense, remove from the Building all of the Lessee’s personal property and such improvements made by the Lessee that have not become the property of the Lessor, including, for example, trade fixtures, cabinets, removable paneling, and partitions, and shall repair all injury done by or in connection with the installation or removal of such property and improvements. Furthermore, the Lessee shall, upon termination of this lease, surrender the premises to the Lessor in good condition, excluding reasonable wear and tear, and excluding any damage caused by fire, weather, the elements, or any other cause not due to the intentional misuse or neglect of the Lessee or the Lessee’s agents, servants, visitors or sublessees.
12. The Lessee shall not, without first obtaining the written consent of the Lessor, make any alterations, additions or improvements in, to or surrounding the Building. However, Lessor’s consent to such alterations, additions or improvements shall not be unreasonably withheld.
13. All of the Lessee’s property that remains in the Building after the expiration of this lease shall be deemed conclusively abandoned by the Lessee and may be removed by the Lessor, with the Lessee reimbursing the Lessor for the cost of such removal. The Lessor shall have such property stored at the Lessee’s risk and expense.
14. The Lessee shall not permit the accumulation of waste or refuse in or on the Building.
15. The Lessee shall not, without first obtaining the written consent of the Lessor, abandon the Building or allow the Building to become vacant or deserted.
16. Throughout the term of this lease and any extension thereof, the Lessee shall have absolute right to sublease any part or all of the Building to any person or entity on such terms and conditions as the Lessee at its sole discretion may deem proper.
17. The Lessee shall arrange for electric service water and telephone service, and shall pay all bills corresponding, to such services.
18. The parties acknowledge that this lease comprises the entire, agreement between the parties, and the parties hereto agree that they rely on no representations, oral or written, in executing this lease other than the provisions forth in this lease.
19. The parties further agree that any modification to this lease must be in writing and executed by both parties.
20. This documents has been prepared in the Arabic and the English languages multiple copies, each of which shall be treated as an original. In the event of a conflict between the Arabic and the English text, the Arabic text shall prevail.
21. Each of the parties hereto acknowledges that it has received its copy of the lease for its reference and records.

1ـ ــــــــــــــــــــــــــــــ، وهو مواطن أردني يحمل هوية رقم _______ الصادرة بمدينة _______ بتاريخ _________ مهنته رجل أعمال، وعنوانه هو ص.ب (____)، ____ ____، المملكة الأردنية الهاشمية, (ويشار إليه فيما يلي بكلمة "المؤجر")، و
2ـ شركة الإعمار للتجارة و الاستثمار، وهي شركة أردنية رقم سجلها التجاري ______، وعنوانها ص.ب (____)، ____ ____، المملكة الأردنية الهاشمية، ويمثلها لغرض إبرام عقد الإيجار هذا وليد السيوطي، وهو مواطن أردني يحمل هوية رقم ______، صادرة بمدينة _________ بتاريخ ___________ (ويشار إليها فيما يلي بكلمة "المستأجر").
اتفق المؤجر والمستأجر بموجب هذا العقد على ما يلي:
1ـ أجر المؤجر بموجب هذا العقد للمستأجر، وقبل المستأجر بموجب هذا العقد أن يستأجر، المبنى والأرض والملحقات المتعارف عليها باسم __________ والتي تقع في __________ (ويشار إليها فيما يلي بكلمة "البناء").
2ـ أجر المؤجر البناء للمستأجر لفترة أولى تمتد خمسة أعوام ميلادية تبدأ في اليوم الأول من سبتمبر عام 2003 وتنتهي في اليوم الحادي والثلاثين من أغسطس عام 2008. وعند انتهاء مدة عقد الإيجار، يتمتع المستأجر بحق تمديد عقد الإيجار لفترتين مماثلتين تمتد كل منهما خمسة أعوام وتنطبق عليهما ذات الأحكام والشروط المبيّنة في عقد الإيجار هذا.
3 ـ ونظير قيام المؤجر بتأجير البناء للمستأجر، على المستأجر أن يدفع للمؤجر أجرة السنة الأولى مبلغاً مقداره ( 32.000) دينار يغطي أجرة الفترة من 1 سبتمبر عام 2003 إلى 31 أغسطس عام 2004 أما بالنسبة للفترة التي تبدأ بتاريخ 1 سبتمبر عام 2004 وتنتهي بتاريخ 31 أغسطس عام 2005، فإن الأجرة تصبح (34.000) دينار، تدفع كاملة في موعد لا يتجاوز اليوم الأول لفترة عقد الإيجار المعنية. وبالنسبة لكل سنة تلي تاريخ 31 أغسطس عام 2004، يتم سنوياً إدخال زيادة على الأجرة مقدارها (3%) ثلاثة بالمئة.
4 ـ لا تعد أجرة السنة الأولى قابلة للاسترداد حتى في حالة عدم تمكن المستأجر من الحصول على التراخيص اللازمة للقيام بالأعمال التي من أجلها يزمع استئجار البناء.
5 ـ ينوي المستأجر أن يستخدم ويشغل البناء بوصفه معرضاً للسيارات وورشة لإصلاح السيارات وذلك بموجب تراخيص يتم الحصول عليها من بلدية ____.
6 ـ يدفع المستأجر الأجرة للمؤجر في عنوان المؤجر المبيّن أعلاه. أو في ذلك المكان الآخر الذي قد يسميه المؤجر كتابة دون الحاجة لمطالبة ودون أي مطالبة مقابلة أو حسم أو مقاصة من أي نوع.
7 ـ التزم المستأجر أن يزود المؤجر بصور من جميع التراخيص الرسمية التي يحصل عليها المستأجر من الحكومة الأردنية ليقوم بإدارة الأعمال التي يعتزم المستأجر القيام بها.
8 ـ عند تلقي شيك بمبلغ أجرة العام الأول من المستأجر وقيام المستأجر والمؤجر بتوقيع هذا العقد، يسلم المؤجر للمستأجر مفتاح البناء حتى يتمكن المستأجر من أن يبدأ أعمال الإنشاء والتغيير في البناء. لا يتم تقاضي أي تكلفة من المستأجر نظير شغل المستأجر للبناء وعمله فيه قبل تاريخ 1 سبتمبر عام 2003.
9 ـ يجب ألا يصدر عن المستأجر أي عمل ينطوي على إساءة استعمال البناء وتجهيزاته الثابتة وملحقاته وعليه العناية بالبناء وتجهيزاته الثابتة وملحقاته وعليه، بصدد استخدام وشغل البناء، التقيد بجميع الأنظمة والأوامر واللوائح ذات الصلة الصادرة عن الحكومة الأردنية.
10ـ تصبح جميع التحسينات التي يدخلها المستأجر على البناء والتي تكون متصلة بالبناء بحيث تتعذر إزالتها دون إلحاق ضرر جوهري بالبناء ملكاً للمؤجر عند انتهاء عقد الإيجار هذا.
11ـ لدى انتهاء عقد الإيجار هذا، على المستأجر القيام، على نفقته الخاصة، بإخلاء البناء من جميع ممتلكات المستأجر الشخصية وعليه إزالة تلك التحسينات التي أدخلها المستأجر على البناء ولم تصبح ملكاً للمؤجر، بما في ذلك مثلاً التجهيزات المهنية العائدة للمستأجر والخزائن والألواح الخشبية لتزيين الجدران القابلة للإزالة وحواجز تقسيم الغرف، وعليه إصلاح كل أضرار تنتج عن تركيب أو إزالة تلك الممتلكات والتحسينات أو فيما يتصل بتركيبها أو إزالتها، وفضلاً عن ذلك، على المستأجر أن يقوم، لدى انتهاء عقد الإيجار هذا، بتسليم العين المؤجرة إلى المؤجر بحالة جيدة، مع استثناء البلى والتلف العاديين الناشئين عن الاستعمال، واستبعاد أي أضرار ناتجة عن الحريق أو الطقس أو العوامل الطبيعية أو عن أي سبب آخر لا يرجع إلى إساءة استعمال أو إهمال متعمد من جانب المستأجر أو وكلاء المستأجر أو مستخدميه أو زواره أو مستأجريه من الباطن.
12ـ لا يجوز للمستأجر أن يقوم، دون الحصول أولاً على موافقة كتابية من المؤجر، بإجراء أي تغييرات أو إضافات أو تحسينات في البناء أو حول البناء. وعلى أية حال، لا يجوز حجب موافقة المؤجر على تلك التغييرات أو الإضافات أو التحسينات دون مسوغ.
13ـ تعد جميع ممتلكات المستأجر التي تبقى في البناء بعد انتهاء مدة هذا العقد متخلى عنها بصورة قاطعة من قبل المستأجر ويجوز أن يقوم المؤجر بإزالتها، مع قيام المستأجر بتعويض المؤجر عن تكاليف تلك الإزالة. وعلى المؤجر تخزين تلك الممتلكات على مسؤولية ونفقة المستأجر.
14ـ لا يجوز للمستأجر السماح بتجمع النفايات أو القمامة في البناء أو على البناء.
15ـ لا يجوز للمستأجر القيام، دون الحصول أولاً على موافقة كتابية من المؤجر، بالتخلي عن البناء أو بالسماح بإخلاء البناء أو تركه.
16ـ طيلة مدة سريان هذا العقد وأي تمديد له، يكون للمستأجر الحق المطلق أن يؤجر من الباطن أي جزء من البناء أو كامل البناء لأي شخص أو كيان وفقاً لتلك الأحكام والشروط التي قد يعدها المستأجر ملائمة وفقاً لتقديره وحده.
17ـ على المستأجر اتخاذ الترتيبات للحصول على خدمات الكهرباء والماء والهاتف، وعليه دفع الفواتير المتصلة بتلك الخدمات.
18ـ أقر الطرفان أن عقد الإيجار هذا يشكل كامل الاتفاق بين الطرفين، وقد اتفق طرفا هذا العقد أنهما لم يعتمدا على أي تأكيدات، شفوية كانت أم كتابية، في توقيع عقد الإيجار هذا خلاف الأحكام المبينة في عقد الإيجار هذا.
19ـ اتفق الطرفان فضلاً عن ذلك على أن أي تعديل لعقد الإيجار هذا يجب أن يكون مكتوباً وأن يوقعه الطرفان.
20ـ تم إعداد هذه الوثيقة باللغتين العربية والإنجليزية من صور متعددة وتعد كل منها أصلاً. وفي حالة وجود تعارض بين النصين العربي والإنجليزي، يعتد بالنص العربي.
21ـ أقر كل من طرفي هذا العقد أنه تسلم صورة من عقد الإيجار للرجوع إليها ولحفظها في سجلاته.
