In un Contratto Preliminare di Compravendita, si parla delle servitù contrattuali o coattive, apparenti o non apparenti, continue o discontinue costituite sul bene immobile e che seguiranno il medesimo bene immobile al momento dell'alienazione.
Ma non mi è chiaro come il Promittente Acquirente (the Purchaser) possa "challenge the easement"...cosa significa esattamente ?

Qualsiasi suggerimento sarà benvenuto ! Grazie mille in anticipo.

Il contesto:

The PURCHASER shall bear all passive easements as may encumber each of the ITALIAN PROPERTIES, whether contractual or statutory, apparent or non-apparent, continuous or discontinuous, which may burden each of the ITALIAN PROPERTIES, except as it may ***challenge such easements***or obtain release therefrom, and shall enjoy all active easements in favour of the ITALIAN PROPERTIES, without any claim or recourse against the SELLER.

He has to bear all easements but he can contest their validity or obtain a release.
