"Die Einantwortung bezeichnet die durch Gerichtsbeschluss erfolgende Übergabe des Nachlasses in den rechtlichen Besitz der Erben. Mit der Einantwortung erlangt der Erbe volle Herrschaft über den Nachlass und wird Schuldner der Erbschaftsgläubiger. Die Einantwortung setzt vor allem eine positive Erbserklärung (Annahme der Erbschaft), den Erbrechtsausweis (Bestätigung des Gerichtes Erbe zu sein) und, wenn der Erbe letztwillig berufen ist, den Testamentserfüllungsausweis (Bestätigung des Gerichtes, die Bedingungen bzw. Auflagen des Testamentes erfüllt zu haben) voraus. "

Nach § 797 ABGB kann der Erbe die Erbschaft nicht eigenmächtig in Besitz nehmen. Das Erbrecht muß vor Gericht verhandelt werden. Das Gericht bewirkt die Einantwortung des Nachlasses, d.h. die Übergabe des rechtlichen Besitzes an den Erben.

Hi Ursula,

You were a bit too hasty in grading. Mag RaWa is right in that transfer of title is too general as a translation for Einantwortung, the correct (specific) translation is "devolution" => einantworten = to devolve (property to heir) (Romain, Legal dico)
