1. The following days are holidays:
(1) Japanese national holidays (as defined in article 3 of the Law on National Holidays for Citizens (Kokumin No Shukujitsu Ni Kansuru Hōritsu), 1948, section 178)
(2) New Year’s holiday period (ie. from December 29th to January 3rd)
2. Once again, the supervisor may override the points above and require the ALT to work on a holiday, provided a temporal compensation has been determined in advance.
3. Holidays are paid days.
PAID LEAVE (nenji yūkyū kyūka)
Article 14
1. The ALT can, upon approval from their supervisor, use up to 20 days of paid leave during their period of appointment as set out in article 4 point 1. These 20 days can be used partially or all at once.
2. Only 10 days of paid leave are given when the ALT starts their appointment; the remaining 10 days are given the first day of the month after the initial 6 months have passed. However, if the ALT makes a formal request, provided the reason given is deemed suitable, the BoE may grant the remaining 10 days before the 6 month period has passed.
3. Once their period of appointment completed, if the BoE renews their contract the ALT shall see their unused paid leave carried over to their next period of appointment, for up to 20 days.
4. Paid leave are calculated as one day, half a day or by the hour.
5. The supervisor may require the ALT to take their leave on a different period than requested if the original period is deemed unfavourable to the smooth conduct of their duties.
SICK LEAVE (byōki kyūka)
Article 15
1. Sick leave is defined as the minimum period needed to recover after getting sick or sustaining an injury during which the ALT is deemed unable to work.
2. Sick leave cannot exceed 20 days in a row. After one period of sick leave (including absence from work as specified in article 17) ends, the ALT must wait 7 days to start a new sick leave period. Shall this 7 day window not be respected, the 2 sick leave periods will be considered as consecutive.
3. The periods mentioned in point 2 above include non-working days and national holidays.
4. Sick leave is paid.
SPECIAL LEAVE (tokubetsu kyūka)
Article 16
1. Special leave can be taken in the following cases for the specified amount of days:
(1) Death of the ALT’s father, mother, spouse etc. – 10 consecutive days for the passing of their father, mother, spouse or child(ren), 5 consecutive days for the passing of siblings or grand-parents.
(2) Marriage – 5 consecutive days when the ALT gets married.
(3) Damages to their residence due to inevitable natural disaster – as long as the city deems necessary to take care of the extent of the damage.
(4) Interruption of transportation (e.g. due to an incident/accident on the road/the public transportation system) on the ALT’s commute – until transportation can be resumed.
(5) Summer leave (granted to maintain and improve mental health) – amount of days as defined by the BoE to be used between July and September.
(6) Pregnancy due within 6 weeks (14 weeks for twins) for female ALTs – until the birth is notified.
(7) Giving birth (for female ALTs) – 8 weeks maximum from the day following the birth. However, this can be shortened to 6 weeks if the ALT reports back to work 6 weeks after giving birth upon their doctor’s approval.
(8) For ALTs with kids under 1 year of age – twice a day for 30 minutes each time.
(9) Painful periods hindering work performance for female ALTs – for the reported days.
(10) For ALTs raising children (including their spouse’s children) that aren’t enrolled in elementary school yet, special leave granted to take care of them – 5 days (10 days in case of multiple children to care for).
(11) Any other special case where taking a leave is deemed necessary by their supervisor – for the period deemed necessary by their supervisor
2. Special leave granted according to points 1 to 5 as well as 11 are paid; special leave granted according to points 6 to 10 are unpaid.
