This MAINTENANCE PLAN is subject to the following Terms, Conditions, and Responsibilities. This PLAN is for the sole benefit of the CUSTOMER named in the attached Plan Schedule and applies only to the MACHINE described in the MACHINE Details section of the Plan Schedule.
Early PLAN termination or adjustment
• The DEALER reserves the right to terminate or adjust this PLAN under exceptional circumstances however should the DEALER decide to take such action the CUSTOMER will retain the right not to accept such changes and receive a refund of the unexpired PLAN value. For the avoidance of doubt such exceptional circumstances could include but not be limited to
o Lubricant prices increase by more than 25%
o The MACHINE operates at /- 25% of the Approximate Average Usage Hours as set out in the Plan Schedule
o Parts and or labour rates increase by more than 12.5% in any 12 month period.
• The CUSTOMER has the right to terminate this PLAN by giving the DEALER 30 days notice prior to the forthcoming scheduled maintenance to be undertaken by the DEALER. In such case the DEALER will refund the unexpired PLAN value less an administration charge of 25% of the unexpired portion.
Any variation to the Terms, Conditions and Responsibilities of the PLAN shall be agreed by both parties in writing.

Rescissione anticipata o modifica del PIANO
• Il CONCESSIONARIO si riserva il diritto di rescindere o modificare il presente PIANO al verificarsi di circostanze eccezionali; tuttavia se il CONCESSIONARIO decidesse di intraprendere tale azione, il CLIENTE si riserva il diritto di non accettare tali modifiche e di ricevere un rimborso pari al valore del PIANO non ancora giunto a scadenza. Al fine di evitare ogni dubbio, tali circostanze eccezionali possono includere tra l’altro:
o aumento del prezzo dei lubrificanti superiore al 25%
o la MACCHINA funziona al /- 25% delle ore di utilizzo medio approssimativo indicate nel piano di manutenzione
o aumento del prezzo dei ricambi e delle tariffe salariali superiore al 12,5% nell’arco di 12 mesi.
• Il CLIENTE ha il diritto di recedere dal presente PIANO previa comunicazione al CONCESSIONARIO 30 giorni prima dell’intervento di manutenzione previsto da parte del CONCESSIONARIO. In questo caso il CONCESSIONARIO è tenuto a rimborsare il valore del PIANO non ancora giunto a scadenza, meno l’onere amministrativo pari al 25% della parte non ancora giunta a scadenza.
Ogni variazione ai Termini, alle Condizioni e alle Responsabilità del presente PIANO dovrà essere concordata per iscritto fra le Parti.
