Ausgangstext - Deutsch § 1 Anwendungsbereich
(1) Eine Person, ohne deren Angaben in einem Strafverfahren die Erforschung des Sachverhalts oder die Ermittlung des Aufenthaltsorts des Beschuldigten aussichtslos oder wesentlich erschwert wäre, kann mit ihrem Einverständnis nach Maßgabe dieses Gesetzes geschützt werden, wenn sie auf Grund ihrer Aussagebereitschaft einer Gefährdung von Leib, Leben, Gesundheit, Freiheit oder wesentlicher Vermögenswerte ausgesetzt ist und sich für Zeugenschutzmaßnahmen eignet.
(2) Mit seinem Einverständnis kann ferner nach Maßgabe dieses Gesetzes geschützt werden, wer Angehöriger (§ 11 Abs. 1 Nr. 1 des Strafgesetzbuches) einer in Absatz 1 genannten Person ist oder ihr sonst nahe steht, auf Grund ihrer Aussagebereitschaft einer Gefährdung von Leib, Leben, Gesundheit, Freiheit oder wesentlicher Vermögenswerte ausgesetzt ist und sich für Zeugenschutzmaßnahmen eignet.
(3) Sofern es für den Zeugenschutz erforderlich ist, können Maßnahmen nach diesem Gesetz auf Angehörige (§ 11 Abs. 1 Nr. 1 des Strafgesetzbuches) einer in Absatz 1 oder 2 genannten Person oder ihr sonst nahe stehende Personen erstreckt werden, wenn diese sich hierfür eignen sowie ihr Einverständnis erklären.
(4) Maßnahmen nach diesem Gesetz können beendet werden, wenn eine der in den Absätzen 1 bis 3 genannten Voraussetzungen nicht vorlag oder nachträglich weggefallen ist. Soweit eine Gefährdung der zu schützenden Person fortbesteht, richten sich die Schutzmaßnahmen nach allgemeinem Gefahrenabwehrrecht. Die Beendigung des Strafverfahrens führt nicht zur Aufhebung der Zeugenschutzmaßnahmen, soweit die Gefährdung fortbesteht.

(1) A person, who is directly or indirectly involved in the fact-finding of the circumstances or in the investigation of the whereabouts of a suspect, and without whose statement the investigation would be unpromising and considerably aggravated; may be protected by this law with their consent, if , due to the cooperation in their testimony, their body, life, health, freedom and personal assets were in danger and if they are suitable for the Witness Protection Program.
(2) A person may be protected in accordance with this law, with their consent, if they are related or in close relationship with the person mentioned in Paragraph 1 (§ 11 par. 1 No. 1 of the Criminal Code) and whose body, life, health, freedom and personal assets were in danger and if they are suitable for the Witness Protection Program.
(3) Actions in accordance with this law may be extended to relatives or persons that have a close relationship with the person mentioned in Paragraph 1 or 2, and if they are suitable for this purpose and declare their consent; if it is essential for the protection of the witness.
(4) Actions in accordance with this law may be terminated, if one of the prerequisites mentioned in Paragraph 1, 2 or 3 did not exist or is subsequently no longer applicable. If there continues to be a danger for the person under protection, protective actions conform to the general Laws of Danger Prevention. The finalization of the criminal proceedings shall not entail suspension of the Witness Protection Preventions, if there continues to be a threat.
