Ausgangstext - Englisch Secondary evidence is also admissible if the production of primary evidence is impossible or inconvenient, e.g. if the production of primary evidence is a violation of law or would cause public inconvenience (Canadian Encyclopedic Digests, Ontario Third Edition, Volume H, § 571) Since delivery of the will is not permissible under German law, this Court is asked, in accordance with the exceptions to the common law Best Evidence rule, to accept the certified copy of the will for the purpose of the appointment of the applicant as administrator to the X estate.
In the alternative, if this Court nonetheless still demands production of the original will, it would be respectfully asked to so state in writing, so as to enable the applicant to apprise the German Estate Court of the circumstances and to approach it with the production request under the given circumstances
Übersetzung - Deutsch Zweitrangiges Urkundenmaterial ist auch dann zulässig, wenn die Vorlage der Ausgangsurkunde unmöglich oder mit den Umständen unvereinbar ist, d.h. wenn die Vorlage der Ausgangsurkunde eine Rechtsverletzung oder ein öffentliches Ärgernis darstellen würde (Canadian Encyclopedic Digests, Ontario Dritte Ausgabe, Band H, § 571). Da eine Zustellung des Testaments gemäß deutscher Rechtsprechung nicht erlaubt ist, ist das Gericht gebeten, in Übereinstimmung mit den Ausnahmen des allgemeinen Gesetzes der Best Evidence Rule (Pflicht der Vorlage des Originaldokuments) die beglaubigte Kopie des Testaments anzuerkennen zum Zweck der Einsetzung des Antragstellers als Verwalter des Vermögens der Frau X.
Alternativ dazu, sollte das Gericht trotz allem auf die Vorlage des Originaltestaments bestehen, würden wir es höflichst bitten, dies in schriftlicher Form zu bestätigen, damit der Antragsteller in die Lage versetzt wird, das deutsche Nachlassgericht über diese Tatsache zu unterrichten und es angesichts der Umstände mit der Forderung der Herausgabe zu konfrontieren.
