Consulting the "best" monolingual legal dictionary from Brazil (Maria Helena Diniz 4 volumes), I find that "na linguagem juridica em geral, eh a omissao ou a nao-observancia de formalidade ou prescricao imposta por lei para a eficacia de um ato juridico.
So the asking party is asking for less money (then the criterios usuais would suggest) because he/she knows he hasn't met all the requirements?
All the entries under this heading of "defeito" , and there are several suggest there's a flaw somewhere. So this is my best "guess" but a little more than a "guess"

Pecar pelo excesso is usually to be overzealous, but also "err on the side of excess".
"To err on the side of" is, as I know, the only similar expression that would allow a rephrasing here...
Something along the lines of:
If anything, the plaintiff errs only on the side of moderation/caution as the demand/claim for...
if any mistake is being made, it is one of caution/moderation
to err on the side of ( ) allows modulation.
err on the side - definition...to err on the side of caution/simplicity → (im Zweifelsfall) zur ... Jack may err, but he always errs on the side of trying to save millions of lives. ...
