My question is, who is doing the evaluating in the phrase " a avaliação desse aspecto" (evaluation/assessment of this aspect)? Is it CONEP?

Hi Roxane-
It is hard to say, without reading a bit more, but my impression is that nobody is. It seems to be something that is beyond the duties of CONEP and that the entity responsible/researcher for the institution should contact the appropriate public entity in order to "evaluate this aspect."
Not sure if that is the same impression you had after reading the entire text. I hope this helps somehow.

I agree with Ana and understand that the researcher should approach the legal department of the appropriate entity (state or municipal) about "the evaluation of this aspect" but the context doesn't make clear just what the researcher is to discuss with this entity.
