La double inconstance fiscale et sociale, fruit d’un triste marivaudage politique, est devenue l’un des gros handicaps de la France.
Les Français seront nombreux à subir des hausses d’impôt à compter du 1er janvier. Le budget 2011, qui a été validé hier soir par le Conseil constitutionnel, ouvre la voie à 11 milliards d’euros de charges supplémentaires, réparties à quasi-égalité entre les ménages et les entreprises. Le gouvernement souligne qu’il n’y a pas de hausse générale d’impôt. Cela aboutit de fait à la mise en oeuvre d’une kyrielle de mesures ciblées. L’Etat attend notamment plus de 1 milliard de la hausse de TVA sur les offres « triple play » (Internet, téléphonie fixe, télévision). Les quelque 70.000 particuliers employeurs déclarant leur employé au salaire réel vont perdre le bénéfice de l’abattement de 15 points sur les cotisations patronales. Les plusvalues immobilières seront taxées à 19 % au lieu de 16 %, tout comme les plus-values mobilières (actions, obligations). Les entreprises, quant à elles, vont être privées de 2 milliards d’euros d’allégements de charges. La valse des impôts va reprendre de plus belle l’an prochain. Des dizaines de dispositifs fiscaux vont changer. Cette instabilité fait hélas partie du paysage.

DELIVERY
Delivery Rules + Policies
Every item on XXXXXX is either handcrafted when you order or produced in limited quantities, so in some instances, same day shipping is not available. XXXXXX and our team of partners takes enormous pride in every product we offer and strive to deliver them in the best possible condition within the requested delivery time.
While there are many things we do to mitigate the risk of shipping fresh products, there are unfortunately some things outside of our control like the weather and delays once the package is in the hands of our couriers. As such, the shipping guidelines published on this website are not guarantees of a shipping or arrival date.
If you are placing an order for a time-sensitive event, we recommend placing your order early and having it arrive early. In some instances due to weather or other uncontrollable events, we may have your product arrive earlier than requested to ensure that it arrives in good condition.
XXXXXX is not responsible for delays in transit caused by high package volume, weather, mechanical error, strikes, natural disasters, terrorism safety control, or inaccurate shipping information, and we do not require a signature for the release of any shipment. Leaving a package at an address is ultimately up to the complete discretion of the individual delivery person and is therefore entirely outside our control.
Customers are responsible for checking that all shipping information is correct before submitting an order as well as in their order confirmation email. Once a package has been shipped, the address can not be altered.
There are no returns, modifications, or cancellations allowed on any orders once it has shipped.

Listing and Selling
Listing Description: By listing an item on the Site you warrant that you and all aspects of the item comply with XXXXXX’s policies. You also warrant that you may legally sell the item. You must accurately describe your item and all terms of sale in your XXXXXX shop. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category with appropriate tags. Each listing must accurately and completely describe the item/items for sale in that listing.
Binding Sale: All sales are binding. The seller is obligated to fulfill the order or otherwise complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance.
Prices: XXXXXX has full authority to charge any price for any item, regardless of what price is being charged by other retails, or by individual sellers.
Prohibited Activities

12. Appear to create liability for XXXXXX or cause XXXXXX to lose (in whole or in part) the services of XXXXXX’s ISPs or other suppliers
13. Link directly or indirectly, reference or contain descriptions of goods or services that are prohibited under this Agreement, the Privacy Policy, or other policy documents as posted on XXXXXX

No Guaranty
XXXXXX does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside XXXXXX’s control.
Legal Compliance
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of XXXXXX’s service and your listing, purchase, solicitation of offers to purchase, and sale of items.
Severability
If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this Agreement shall remain in full force and effect.
No Agency

If the alterations constitute a material change to the Terms of Use, XXXXXX will notify you via email to the email address in your account. What constitutes a “material change” will be determined at

Choice of Law

Survival

Notices

بإمكان xxxxxx، ولصالح المستخدمين، محاولة مساعدتهم على حل النزاعات. يقوم xxxxxx بذلك بتقديره لوحده، فهو ليس مُلزما بحل النزاعات بين المستخدمين أو بين المستخدمين وأطراف خارجية. بقدر ما يحاول xxxxxx حل نزاع ما، فإنه يفعل ذلك بحسن نية استنادًا فقط إلى سياساته، ولن يقوم بإصدار الأحكام بشأن المسائل القانونية أو المطالبات.
الملكية الفكرية لxxxxxx
تم تسجيل xxxxxx، وغيرها من رسومات وشعارات وتصاميم ورؤوس الصفحات والأيقونات والنصوص وأسماء الخدمات الخاصة بxxxxxx كعلامات تجارية، علامات تجارية في المملكة العربية السعودية و/أو بلدان أخرى. لا يجوز استخدام العلامات التجارية والمظهر التجاري لxxxxxx بما في ذلك جزء من العلامات التجارية و/أو جزء من أسماء النطاقات أو عناوين البريد الإلكتروني في اتصال مع أي منتج أو خدمة بأي طريقة من المحتمل أن تُسبب ارتباكًا.
الدخول والوصل

دون تحديد أي تدابير أخرى، بإمكان xxxxxx، دون سابق إنذار، ودون رد أي رسوم، أن يقوم بتأخير أو إزالة المحتوى فورًا، وتحذير مجتمع xxxxxx من نشاطات مستخدم ما، وإصدار تحذير للمستخدم، وتوقيف مستخدم ما مُؤقتًا، وتعليق امتيازات حساب المستخدم مُؤقتًا أو إلى أجل غير مسمى، وإنهاء حساب المستخدم، وحظر الولوج إلى الموقع، واتخاذ خطوات فنية وقانونية لإبقاء المستخدم بعيدا عن الموقع، ورفض تقديم الخدمات للمستخدم إذا كانت تنطبق عليه أي من الحالات التالية:
يشتبه xxxxxx (عن طريق المعلومات والتحقيق والإدانة والتسوية أو التأمين أو التحقيقات الخاصة أو غير ذلك) بأن مستخدما قد خرق هذه الاتفاقية وسياسة الخصوصية أو وثائق السياسات الأخرى والمبادئ التوجيهية للمجتمع المدرجة هنا. ليس بإمكان xxxxxx التحقق من صحة أي من معلوماتك الشخصية أو المحتوى، أو أن يجزم بأن المستخدم يتصرف بشكل غير مُتسق مع نص أو روح سياسات xxxxxx، أو قد انخرط في نشاط غير لائق أو احتيالي في اتصال بxxxxxx، أو أن التصرفات قد تنجم عنها مسؤولية قانونية أو خسارة مالية لxxxxxx أو لمستخدميه.
الخصوصية

الضمان
يؤمن xxxxxx وفروعه ومسؤولوه ومديروه وموظفوه ومزودوه موقع ويب xxxxxx والخدمات "كما هي" وبدون أي ضمانات أو شروط صريحة أو ضمنية أو قانونية. يُخلي xxxxxx وفروعه ومسؤولوه ومديروه وموظفوه ومزودوه أنفسهم من أي ضمانات ضمنية متعلقة بالتحديد بالأصول والرواج والأداء والملائمة لغرض معين ولعدم الانتهاك. بالإضافة إلى ذلك، لا تشكل أية نصيحة أو معلومة (شفوية أو مكتوبة) حصلت عليها من xxxxxx أي ضمان، إلا أن بعض الدول لا تسمح بالتنصل من الضمانات الضمنية وبالتالي فإن الشروط الآنفة الذكر قد لا تنطبق عليك. يمنحك هذا الضمان حقوقا قانونية معينة كما يمكن أن يكون لك حقوق قانونية أخرى.
حدود المسؤولية
لا يتحمل xxxxxx و(حسب مقتضى الحال) فروعه ومسؤولوه ومديروه وموظفوه ومزودوه، في أي حال من الأحوال، المسؤولية عن أي أضرار من أي نوع، سواء كانت مباشرة أو غير مباشرة، عامة أو خاصة، تعويضية أو تبعية، و/أو عرضية أو ناجمة عن تصرفك أو متعلقة بك أنت أو أي شخص آخر في اتصال مع استخدام هذا الموقع، أو خدمات xxxxxx، أو هذا الاتفاقية، بما في ذلك، على سبيل المثال لا الحصر، خسارة الأرباح أو الإصابات الجسدية أو الاضطراب العاطفي أو أي أضرار خاصة أو عرضية أو تبعية.
تقتصر مسؤولية xxxxxx و(حسب مقتضى الحال) فروعه ومسؤوليه ومديريه وموظفيه ومزوديه تجاهك أو تجاه أي طرف ثالث تحت أي ظرف وفي أقصى الحالات على (أ) مبلغ الرسوم التي تدفعها لxxxxxx خلال الأشهر ال 12 الماضية قبل ارتكاب الفعل الذي أسفر عن تلك المسؤولية، و (ب) 300 ريال سعودي.
التعويض
أنت توافق على تعويض xxxxxx و(حسب مقتضى الحال) فروعه ومسؤوليه ومديريه وموظفيه ومزوديه، وتعفي xxxxxx ومن أي ادعاء أو مطالبة، بما في ذلك أتعاب المحاماة المعقولة التي يقوم بها أي طرف ثالث بسبب خرقك لهذه الاتفاقية أو الوثائق التي تضمنها كمراجع، أو خرقك لأي قانون أو حقوق طرف ثالث.
الضمان
لا يُقدم xxxxxx أي ضمان للدخول المتواصل غير المتقطع للموقع، وعمله قد تتدخل فيه العديد من العوامل خارج طاقة xxxxxx.
الامتثال القانوني
يجب عليك أن تمتثل لجميع القوانين الوطنية والدولية، والمراسيم واللوائح الجاري بها العمل بخصوص استعمالك لخدمات xxxxxx والمنتجات المدرجة وعروض استقطاب العملاء، وبيع المنتجات الخاصة بك.
قابلية الفصل
في حالة بطلان أي بند من بنود هذه الاتفاقية، فسيتم تعديلها لتعكس نوايا الأطراف، ويظل لباقي البنود كامل النفاذ والأثر.
الوكالة

يحتفظ xxxxxx بحق تعديل أو وقف خدمته في أي وقت، بدون إشعارك، لأي سبب من الأسباب. كما يحتفظ أيضا بحق تعديل شروط الاستخدام أو سياسات الموقع الإلكتروني الأخرى في أي وقت. إذا شكلت التعديلات تغييرًا جوهريًا في شروط الاستخدام، فإن xxxxxx سيقوم بإشعارك عبر إرسال رسالة للبريد الإلكتروني الخاص بحسابك. ما يشكل تغييرا جوهريا يتم تحديده
بتقدير xxxxxx وحسن النية واستخدام الحس السليم والتقدير العقلاني.
اختيار القوانين
يجب أن تُؤول وتُفسر هذه الاتفاقية من جميع الجوانب من خلال/وعبر قوانين المملكة المتحدة، والنزاعات الناشئة بموجب هذه الاتفاقية سيتم النظر فيها بمحاكم المملكة المتحدة.
استمرار الاتفاقية
المواد 3 (الرسوم والخدمات، الرسوم وإنهاء الاتفاقية)، و 6 (المحتوى، الترخيص)، و 8 (مراقبة المعلومات)، و 8 (حل النزاعات والإعفاء)، و 9 (الملكية الفكرية لxxxxxx)، و 10 (الدخول والوصل)، و 11 (الخرق) و 12 (الخصوصية)، و 13 (الضمان (، و 14 (تحديد المسؤولية(، و 15 (التعويض(، و 16 (الضمان(، و 18 (قابلية الفصل(، و 19 (الوكالة(، و 21 (اختيار القوانين( ستظل سارية المفعول بعد إنهاء أو انتهاء مدة هذه الاتفاقية.
إشعارات
باستثناء ما ذكر خلافا لذلك صراحة، فإن أي إشعار يجب أن يرسل عبر البريد الإلكتروني إلى xxxxxx، أو في حالتك إلى عنوان البريد الإلكتروني الذي قدمته (سواء خلال عملية التسجيل أو عند تغيير عنوان بريدك الإلكتروني .(يُفترض أن يصل الإشعار بعد 24 ساعة من إرسال رسالة البريد الإلكتروني، إلا إذا تلقى الطرف المُرسل إشعارًا بأن عنوان بريده الإلكتروني غير صالح. يمكن لxxxxxx، بدلًا من ذلك، أن يرسل لك إشعارًا عبر البريد المسجل أو رسم البريد المدفوع سلفًا وطلب وصل الإرجاع إلى العنوان المُقدم لxxxxxx. في هذه الحالة، يُفترض أن يصل الإشعار بعد ثلاثة أيام من تاريخ إرسال البريد.
