OTORGAMIENTO DE LICENCIAS
CAPÍTULO I
AUTORIZACIONES Y OTORGAMIENTO DE LICENCIAS
Article 25.- (FORMAS DE OTORGAMIENTO DE LICENCIAS). I. La Licencia Única y la Licencia de Radiodifusión, deberán ser otorgadas por la ATT a través de la suscripción de contratos.
II. Las Licencias para Redes Privadas, Servicios de Valor Agregado y Provisión de Servicios Satelitales, así como las Habilitaciones Específicas, serán otorgadas por la ATT mediante Resoluciones Administrativas, que contengan la información relevante y uniforme para cada tipo de autorización.
III. Las Licencias para el Uso de Frecuencias destinadas a servicios de telecomunicaciones al público, serán otorgadas por la ATT según corresponda, por un proceso de licitación pública o de forma directa, mediante Resoluciones Administrativas.
IV. Para propósitos del presente Reglamento, el otorgamiento de licencias de forma directa deberá entenderse como el otorgamiento de una licencia en función de los planes aprobados por el Ministerio de Obras Públicas, Servicios y Vivienda, la disponibilidad de frecuencias y el cumplimiento previo de los requisitos para cada caso.
Article 26.- (REGISTRO ÚNICO DE LICENCIAS). La ATT incorporará el Registro Único de Licencias al Sistema de Información Sectorial.
Article 27.- (ÁREAS DE AUTORIZACIÓN Y DE SERVICIO). I. Se establece las siguientes Áreas de Autorización para la provisión de servicios de telecomunicaciones en función del alcance geográfico de la licencia.
a) Área de Autorización Nacional – AAN, es aquella que incluye todo el territorio del Estado Plurinacional de Bolivia.
b) Área de Autorización Departamental – AAD, es aquella que incluye todo el territorio de un departamento.
II. Se establece las siguientes Áreas de Servicio:
a) Área de Servicio Urbana - ASU: Es el área geográfica que comprende una o más localidades o ciudades, para la provisión de un servicio.
b) Área de Servicio Rural - ASR: Es toda área geográfica de un departamento que se encuentra fuera de las Áreas de Servicio Urbano establecidas, para la provisión de un servicio.
III. Los operadores y proveedores de servicios de telecomunicaciones y tecnologías de información y comunicación prestarán servicios dentro del ASU y ASR habilitada, dentro de la AAN ó AAD autorizada en sus correspondientes licencias otorgadas por la ATT.
IV. Las áreas de servicio determinadas deberán ser comunes para todos los operadores.
V. El presente Article no se aplicará a las Licencias de Radiodifusión.
Article 28.- (TRÁMITE Y SEGUIMIENTO). I. La ATT, establecerá los procedimientos administrativos internos para el trámite de otorgamiento de licencias y su seguimiento. Dichos procedimientos serán emitidos con el objeto de asegurar un trato igualitario a todas las solicitudes de licencias, su posterior regulación, fiscalización y control.
II. Durante el trámite para otorgar licencias, la transferencia o modificación en el control efectivo del solicitante, significará el rechazo de la solicitud y conllevará al inicio de un nuevo trámite por parte del nuevo titular.
III. Durante el trámite de obtención de una licencia, la información y documentación técnica y económica, que sea presentada por los solicitantes para el otorgamiento de licencias, será considerada por la ATT como confidencial.
Article 29.- (TITULAR DE LA LICENCIA). I. Son titulares de licencias las personas naturales y jurídicas que han solicitado por sí y para sí un título habilitante para la prestación de servicios en telecomunicaciones o para redes privadas dentro del territorio nacional.
II. En el caso de sociedades comerciales, se considera poseedor del control efectivo a la persona natural o jurídica que tiene el control de las decisiones dentro de la sociedad en el marco de lo establecido por el Código de Comercio.
III. En el caso de sociedades comunitarias, asociaciones de hecho o cualquier otra forma de asociación legalmente reconocida por el Estado Plurinacional de Bolivia, se presumirá que el control efectivo es ejercido por la totalidad de los socios o miembros.
IV. Para el caso de entidades públicas, empresas públicas estratégicas o sociedades comerciales con participación mayoritaria del Estado Plurinacional de Bolivia, para efectos de representación, el titular de la licencia es la Máxima Autoridad Ejecutiva o el Gerente General, según corresponda.
V. Si una sociedad comercial mantiene la titularidad de una licencia dentro de una Corporación o Holding, se presumirá que quien posee el control efectivo es la matriz de éstas.
Article 30.- (HOLDING). A los fines del presente Reglamento, se entenderá por Holding al conjunto de empresas del sector, organizadas en torno a una sociedad controladora o matriz constituida dentro o fuera del territorio nacional, que administra y controla la totalidad o una parte significativa de las cuotas de capital o acciones de una dependiente.
Article 31.- (PROHIBICIONES Y LIMITACIONES). I. No podrán ser sujetos de otorgamiento de derechos las personas naturales o jurídicas, miembros de juntas o consejos directivos y socios de personas jurídicas a quienes por cualquier causal se les haya revocado la licencia para operar una red y proveer servicios de telecomunicaciones y tecnologías de información y comunicación o revocado la licencia para hacer uso del espectro radioeléctrico. Esta prohibición se aplicará a servicios similares al servicio u operación de la red que fue objeto de la revocatoria y por un periodo de cinco (5) años.
II. La prohibición establecida por la Ley N° 164 para el otorgamiento de licencias por causal de revocatoria de licencia, no es aplicable cuando la revocatoria de licencia se hubiera producido a petición expresa del operador o proveedor.
III. Ningún solicitante infractor a la normativa regulatoria podrá adquirir nuevos derechos, renovar, modificar o revocar los vigentes, sin que hayan cesado los actos irregulares que dieron origen al proceso sancionador.
IV. Las licencias o solicitudes en curso para la obtención de licencias no podrán ser transferidas, cedidas o arrendadas, salvo las establecidas en el presente Reglamento; en caso de comprobarse aquello, será causal de revocatoria de la licencia o el rechazo de la solicitud por parte de la ATT.
V. Los proveedores nacionales o internacionales del servicio de distribución de señales satelitales directas DTH (Direct To Home) que su señal tenga cobertura en el territorio del Estado Plurinacional de Bolivia no podrán prestar este servicio sin contar con el título habilitante correspondiente.
CAPÍTULO II
OBTENCIÓN DE LICENCIAS
Article 32.- (OTORGAMIENTO DE LICENCIAS). I. Los interesados en obtener una licencia para operar redes y proveer servicios de telecomunicaciones y tecnologías de información y comunicación, deben cumplir con la presentación de los requisitos legales, económicos y técnicos de acuerdo al tipo de servicio solicitado.
II. En el otorgamiento de licencias para redes privadas y públicas que requieran de la utilización de frecuencias y por consiguiente de la Licencia para el Uso de Frecuencias, podrán ser consideradas en su presentación de manera conjunta, conteniendo la información y requisitos exigidos para ambas licencias, siguiendo su proceso independiente de otorgamiento.
Article 33.- (CARÁCTER DE DECLARACIÓN JURADA). Toda la documentación presentada ante la ATT para trámites de solicitudes de licencias, tendrá carácter de declaración jurada.
Article 34.- (DOCUMENTACIÓN Y PROCEDIMIENTO PARA SOLICITUD DE LICENCIAS Y HABILITACIONES ESPECÍFICAS). Las solicitudes para la obtención de las licencias y habilitaciones específicas, deberán acompañarse de la documentación legal, técnica y económica, según corresponda, determinada mediante Resolución Ministerial emitida por el Ministerio de Obras Públicas, Servicios y Vivienda, que además establecerá el procedimiento para el otorgamiento.
Article 35.- (REDES PRIVADAS ITINERANTES). I. Las Licencias para Red Privada de empresas que por su rubro de trabajo en la implementación de proyectos en áreas específicas de operación requieran de frecuentes y significativas modificaciones de ubicación geográfica, podrán solicitar modificaciones de su licencia a la ATT previo cumplimiento de los requisitos establecidos, sin que esto se considere una nueva solicitud de licencia.
II. Las Redes Privadas mencionadas en el Parágrafo anterior, para beneficiarse de este tipo de modificación de licencia, deberán preservar las características técnicas de los equipos de la red, frecuencias a utilizar, ancho de banda, número de canales, potencias y número de unidades móviles.
Article 36.- (EXENCIÓN DE PAGO DE TASAS Y DERECHOS). En los casos establecidos en la Ley Nº 164, las solicitudes de exención de pagos por Derecho de Asignación de Frecuencias - DAF y Derecho de Uso de Frecuencias - DUF, así como la Tasa de Fiscalización y Regulación, serán presentadas a la ATT para su correspondiente evaluación de cumplimiento de los aspectos legales y técnicos establecidos para el otorgamiento de la licencia, a fin de remitir al Ministerio de Obras Públicas, Servicios y Vivienda, la solicitud con los informes técnico y legal para la respectiva autorización, mediante Resolución Ministerial, que instruya la exención del pago de Tasas y Derechos respectivos, si corresponde.
CAPÍTULO III
LICENCIA ÚNICA, HABILITACIÓN ESPECÍFICA
Y LICENCIA PARA USO DE FRECUENCIA
Article 37.- (LICENCIA ÚNICA). I. La ATT, otorgará Licencia Única para la operación de redes o la prestación de servicios de telecomunicaciones y tecnologías de información y comunicación, con alcance departamental o nacional, a través de la suscripción de un contrato, previo cumplimiento de los requisitos legales, económicos y técnicos y el procedimiento establecido por el Ministerio de Obras Públicas, Servicios y Vivienda mediante Resolución Ministerial.
II. El interesado a tiempo de solicitar la Licencia Única, deberá requerir mínimamente la habilitación de un servicio a través de una habilitación específica.
III. Los operadores de redes públicas de telecomunicaciones y tecnologías de información y comunicación que requieran para su operación el uso de frecuencias, deberán solicitar la Licencia para el Uso de Frecuencias.
Article 38.- (HABILITACIÓN ESPECÍFICA). I. A solicitud expresa de los operadores y proveedores de servicios de telecomunicaciones y tecnologías de información y comunicación, la ATT mediante Resolución Administrativa, podrá habilitar un servicio que no hubiera sido implementado al momento del otorgamiento de la Licencia Única.
II. Las licencias para los servicios, que requieran el uso de frecuencia deberán sujetarse a los Planes de Asignación de Frecuencias que serán emitidos por el Ministerio de Obras Públicas, Servicios y Vivienda.
Article 39.- (LICENCIA PARA EL USO DE FRECUENCIAS). La ATT otorgará Licencias para el Uso de Frecuencias radioeléctricas a los operadores o proveedores de servicios de telecomunicaciones y tecnologías de información y comunicación, radiodifusión y redes privadas, siempre y cuando cumplan con lo establecido en el Plan Nacional de Frecuencias, exista disponibilidad y sea de acuerdo a las formas de otorgamiento definidas en el presente Reglamento.
Article 40.- (PROCEDIMIENTO DE OTORGAMIENTO DE LICENCIAS PARA EL USO DE FRECUENCIAS). I. El otorgamiento de Licencias para el Uso de Frecuencias destinadas a los servicios de telecomunicaciones al público, se realizará a través de licitación pública o de forma directa y se sujetará al procedimiento establecido por el Ministerio de Obras Públicas, Servicios y Vivienda mediante Resolución Ministerial.
II. Las Licencias para el Uso de Frecuencias destinadas a los servicios de radiodifusión, se otorgarán sujetándose al procedimiento establecido por el Ministerio de Obras Públicas, Servicios y Vivienda mediante Resolución Ministerial, de la siguiente manera:
a) De forma directa para el Estado,
b) Por Concurso de proyectos para el sector social comunitario y pueblos indígena originario campesinos y comunidades interculturales y afrobolivianas,
c) Por Licitación pública para el sector comercial.
III. Las Licencias para el Uso de Frecuencias destinadas a redes privadas, se otorgarán de forma directa y se sujetarán al procedimiento establecido por el Ministerio de Obras Públicas, Servicios y Vivienda mediante Resolución Ministerial.
Article 41.- (USO DE FRECUENCIA CON CARÁCTER EXPERIMENTAL). I. Para promover la investigación y el desarrollo de las telecomunicaciones a través del uso de nuevas tecnologías, la ATT podrá otorgar Licencias de Uso de Frecuencia con carácter experimental por un plazo de hasta seis (6) meses no renovables, para experimentos en el espectro radioeléctrico consistentes con normas internacionales, siempre y cuando estos experimentos estén en el marco de la normativa vigente, sirvan al interés público y no causen interferencia perjudicial.
II. Los solicitantes deberán cumplir con la presentación de los requisitos legales y técnicos exigidos por la ATT según aplique en cada caso y de acuerdo a instructivos elaborados por la ATT.
III. La ATT, fijará el pago de duodécimas acordes al plazo por los derechos de asignación y uso de frecuencias DAF y DUF para el otorgamiento de licencias experimentales.
Article 42.- (USO DE FRECUENCIA DE CARÁCTER EXCEPCIONAL). I. Las delegaciones diplomáticas podrán acceder a una autorización de uso de frecuencias con carácter excepcional por un plazo no mayor a un mes, en caso de visitas oficiales, comunicadas a la ATT por el Ministerio de Relaciones Exteriores, en el marco de los convenios internacionales.
II. En casos de emergencia declarada, en coordinación con el Sistema Nacional de Reducción de Riesgos y Atención de Desastres y Emergencias – SISRADE, la ATT podrá otorgar Licencias para el Uso de Frecuencia sin costo, por un plazo no mayor a tres meses, pudiendo ampliarse dicho plazo en caso de continuar el periodo de la emergencia.
III. Previa autorización de la ATT, los operadores con Licencia para el Uso de Frecuencias podrán realizar nuevos emplazamientos de radio bases u otra infraestructura por un periodo limitado y establecido en la autorización para la provisión de servicios de telecomunicaciones al público, en sitios específicos donde se realicen eventos de carácter público.
Article 43.- (PROHIBICIÓN DE USO DE FRECUENCIAS SIN LICENCIA). Ninguna persona natural o jurídica dentro del territorio nacional del Estado Plurinacional de Bolivia podrá hacer uso de frecuencias radioeléctricas establecidas en el PNF, sin contar previamente con la licencia correspondiente emitida por la ATT, salvo frecuencias de uso libre establecidas en dicho plan.
CAPÍTULO IV
LICENCIA DE RED PRIVADA Y LA ACTIVIDAD DE RADIOAFICIONADOS
Article 44.- (LICENCIA DE RED PRIVADA). I. La ATT, otorgará Licencia para Redes Privadas, para la operación de redes de telecomunicaciones y tecnologías de información y comunicación que se extiendan fuera del predio del propietario de la misma y a radioaficionados, a través de Resolución Administrativa, previo cumplimiento de los requisitos legales y técnicos establecidos por el Ministerio de Obras Públicas, Servicios y Vivienda.
II. Los operadores de redes privadas de telecomunicaciones y tecnologías de información y comunicación que requieran para su operación el uso de frecuencias radioeléctricas, deberán contar adicionalmente y de manera previa con la Licencia para el Uso de Frecuencias respectiva.
Article 45.- (ACTIVIDAD DE RADIOAFICIONADOS). Las bandas y frecuencias asignadas en el PNF para la actividad de radioaficionados, podrán ser utilizadas siempre y cuando se cuente con la debida Licencia de Radioaficionado. Estas bandas y frecuencias no podrán ser asignadas al uso exclusivo de ninguna persona individual ni colectiva.
Article 46.- (OBLIGACIONES Y RESPONSABILIDADES). I. Los radioaficionados, en función a los fines de servicio a la comunidad, no podrán tener finalidad comercial ni dar lugar a beneficios económicos, debiendo atender los requerimientos de colaboración.
II. Los radioaficionados serán responsables de adoptar las precauciones técnicas y de seguridad para evitar interferencias y perturbaciones en los otros servicios de telecomunicaciones, haciéndose pasibles a las sanciones establecidas en el Reglamento de Infracciones y Sanciones, en caso de presentarse éstas.
III. Los radioaficionados quedan terminantemente prohibidos de interconectar sus equipos a las redes públicas con fines de lucro.
Article 47.- (CONTROL DE EMISIONES). La ATT, controlará que las emisiones de las estaciones de los radioaficionados cumplan el estándar técnico establecido para el efecto.
CAPÍTULO V
LICENCIA PARA SERVICIOS DE VALOR AGREGADO
Article 48.- (SERVICIOS DE VALOR AGREGADO). I. La ATT regulará el funcionamiento, el otorgamiento de licencia, los términos y condiciones de la prestación del servicio; así como el pago de la Tasa de Fiscalización y Regulación de los servicios de valor agregado.
II. Los operadores o proveedores de redes públicas con Licencia Única, legalmente constituidos en el Estado Plurinacional de Bolivia, podrán prestar servicios de valor agregado directamente, sin requerir de una Licencia para Servicios de Valor Agregado, para lo cual deberán solicitar a la ATT la habilitación correspondiente.
Article 49.- (PRESTACIÓN DE SERVICIOS). I. Los operadores o proveedores que presten Servicios de Valor Agregado, deberán llevar una contabilidad de acuerdo al sistema de información contable de la ATT.
II. Los operadores de redes públicas y proveedores de servicios al público están obligados a exigir la presentación de la Licencia para Servicios de Valor Agregado o de la Licencia Única, según corresponda, a proveedores de este servicio, de manera previa a la asignación de una línea o circuito en alquiler o cualquier otra facilidad de acceso a la red.
Article 50.- (HABILITACIÓN Y DESHABILITACIÓN). I. Los operadores o proveedores de servicios de valor agregado, deberán facilitar a sus usuarias o usuarios la habilitación y deshabilitación de los servicios que prestan en las mismas condiciones.
II. Los operadores o proveedores de Servicios de Valor Agregado, previo a la suscripción de una usuaria o usuario a cualquiera de los servicios ofertados, tienen la obligación de comunicar al suscriptor sobre el servicio al que accederá, forma de pago y forma de finalización de la suscripción. Si la suscripción implica la prestación continua de un servicio, el operador o proveedor deberá solicitar la aceptación expresa de la usuaria o usuario indicando el plazo, costo de la suscripción y mecanismos de reclamación.
Article 51.- (SUSPENSIÓN DE SERVICIOS). I. La ATT, previo informe técnico y legal, podrá ordenar suspender la prestación de los servicios de valor agregado en los siguientes casos:
a) Cuando se demuestre que su operación está causando daño al correcto funcionamiento de la red de telecomunicaciones que lo soporta
b) Cuando el servicio atente contra las usuarias o usuarios.
c) Cuando se trate de operaciones o aplicaciones fuera del alcance de sus licencias.
II. Dicha suspensión se mantendrá, hasta que se acredite que el operador ha resuelto satisfactoriamente la causa que lo originó.
Translation - English TITLE III
GRANTING OF LICENSES
CHAPTER I
AUTHORIZATION AND GRANTING OF LICENSES
Article 25.- (FORMS OF ISSUING OF LCENSES). I. The Unique License and the Broadcasting License, must be issued by ATT through the subscription of contracts.
II. Licenses for Private Networks, Added-Value Services and Providers of Satellite Services, as well as Specific Releases, will be issued by ATT through Administrative Resolution, that contains the relevant and uniform information for each type of authorization.
III. Licenses for the Use of Frequency destined to services of telecommunications to the public, will be issued by ATT correspondingly, for a process of public tendering or in direct form, through Administrative Resolutions.
IV. For purposes in the present Regulation, the issuing of licenses in direct form must be understood as the issuing of a license in function of the approved plans by the Ministry of Public Works, Housing and Service, the availability of frequencies in the fulfillment prior to the requisites for each case.
Article 26.- (UNIQUE REGISTER OF LICENSES). ATT will incorporate the Unique Register of Licenses to the System of Sector Information.
Article 27.- (AREAS OF AUTHORIZATION AND SERVICE). I. The following Areas of Authorization are established for the services provided in telecommunications in function to the geographical reach of a license.
a) National Authorization Area- NAA, is that which includes all territory of the Plurinational State of Bolivia.
b) Departmental Authorization Area– DAA, is that which includes all territory in a department.
II. The following Areas of Service are established:
a) Area of Urban Service - AUS: Is the geographical area that comprises one ore more localities or cities, for the services provided.
b) Area of Rural Service- ARS: Is all the geographic area of a department that finds itself outside the established Areas of Urban Service for the services provided.
III. Operators and providers of services in telecommunication and technologies of information and communication will lend out services within the empowered AUS and ARS, within the NAA or DAA authorized in their corresponding licenses issued by ATT.
IV. The areas of service determined must be common for all the operators.
V. The present Article will not apply to the Broadcasting Licenses.
Article 28.- (PROCEEDING AND MONITORING). I. ATT will establish the internal administrative procedures for proceeding the issuing of licenses and monitoring. Such procedures will be issued with the purpose to ensure equal treatment in all requests for licenses, its subsequent regulation, control and inspection.
II. During the proceeding for the issuing of licenses, the transference or modification in the effective control of the requester, would signify the rejection of the application and will lead to the beginning of a new proceeding on behalf of the new titleholder.
III. During the proceeding for obtaining a new license, the information, technical and economic documentation, that is presented by the applicants for the issuing of licenses, will be considered by ATT as confidential.
Article 29.- (TITLEHOLDERS OF A LICENSE). I. Titleholders of licenses are those persons natural and legal that have requested by themselves and for themselves an enabling title for the rendering of services in telecommunications or for private networks within national territory.
II. In case of commercial societies, one is considered owner of the effective control, the person natural or legal that has control of the decisions within the society in the established framework by the Commercial Code.
III. In case of communitarian societies, fact associations or any other form of association legally recognized by the Plurinational State of Bolivia, shall be presumed that the effective control is exercised by the totality of its partners or members.
IV. For the case of public entities, strategic public businesses or commercial societies with the participation of the majority of the Plurinational State of Bolivia, for effects of representation, the titleholder of a license is the Maximum Executive Authority or the General Manager, accordingly.
V. If a commercial society maintains the ownership of a license within a Corporation or Holding, it shall be presumed that whomever possesses the effective control is the matrix of these.
Article 30.- (HOLDING). For the purposes of the present Regulation, it will be understood as Holding the set of businesses in the sector, that are organized surrounding a controlled society or constituted matrix within or outside the national territory, that administers and controls the totality of significant part of the fees of the capital or the shares of a subsidiary.
Article 31.- (PROHIBITIONS AND RESTRICTIONS). I. They will not be subject of issuing of rights those persons natural or legal, members of the board or council directors and partners of legal persons to whom by any causal has their license been revoked for operating a network and providing services in telecommunications and technologies in information and communication or the licenses has been revoked to make use of the radio electric spectrum. This prohibition will be applied to similar services or a network operation that was aimed to the revocation and for a period of five (5) years.
II. The prohibition established by Law N° 164 for the issuing of licenses for causal of a revocation of a license, is not applicable when the revocation of a license has been produced at express petition form the operator or provider.
III. No applicant that has infringed to the regulation norm can acquire new rights, renovate, modify or revoke the valid, without having ceased the irregular acts that gave origin to the sanctioning process.
IV. Licenses or applications in course for the obtaining of licenses will not be transferred, turned over or leased, except the established in the present Regulation; in case of that being proved, it will be causal the revocation of a license or the rejection of an application on behalf of ATT.
V. The national or international providers of the distribution service of direct satellite signals DTH (Direct To Home) that has a signal with coverage in the territory of the Plurinational State of Bolivia will not be able to loan this service without counting with the corresponding enabling title.
CHAPTER II
OBTAINING LICENSES
Article 32.- (ISSUING OF LICENSES). I. Those interested in obtaining a license to operate networks and provide services of telecommunications and technologies of information and communication, must comply with the presentation of the legal document requisites, economic and technical according to the type of service requested.
II. In the issuing of licenses for private and public networks that require the utilization of frequencies and therefore the License for the Use of Frequencies, could be considered in their presentation in a joint manner, containing the information and requisites demanded for both licenses, following its independent process of issuing.
Article 33.- (NATURE OF STATUTORY DECLARATION). All documentation presented before ATT for the procedures of applications of licenses, will have a nature of statutory declaration.
Article 34.- (DOCUMENTATION AND PROCEDURE FOR REQUESTING LICENSES AND SPECIFIC RELEASES). The applications for obtaining licenses and specific releases, must be accompanied by the legal documentation, technical and economical, accordingly as corresponded, determined through Ministerial Resolution issued by the Ministry of Public Works, Housing and Service, that will also establish the procedure for the issuing.
Article 35.- (ITINERANT PRIVATE NETWORKS). I. The Licenses for Private Networks in businesses that because of their area of work in the implementation of projects in specific areas of operation require significant and frequent modifications of geographical location, could request modifications in their license to the ATT prior fulfillment of the established requisites, without this being considered a new request of a license.
II. The Private Networks mentioned in the previous Paragraph, to benefit from this type of modification of a license, must preserve the technical characteristics of the equipments of the networks, frequencies that will be used, bandwidth, number of channels, potencies and number of mobile units.
Article 36.- (EXEMPTION OF FEE PAYMENTS AND RIGHTS). In the established cases of Law Nº 164, the requests for exemption of payments by Assignation of Rights of Frequencies-ARF and Rights of Use of Frequencies-RUF, as for the Inspection Fee and Regulation, will be presented to the ATT for the corresponding evaluation of fulfillment of the legal and technical aspects established for the issuing of a license, with the goal to remit to the Ministry of Public Works, Housing and Service, the application with the technical and legal reports for the respective authorization, through Ministerial Resolution, that instructs the exemption of Fees and Rights payments respectively, if corresponded.
CHAPTER III
SINGLE LICENSE, SPECIFIC RELEASE AND LICENSE FOR THE USE OF FREQUENCY
Article 37.- (SINGLE LICENSE). I. ATT will issue Single License to the operation of networks or the lend out of services in telecommunications and technologies of information and communication, with national or departmental reach, through the subscription of a contract, prior fulfillment of the legal requisites, economic and technical and the proceeding established by the Ministry of Public Works, Housing and Service through Ministerial Resolution.
II. The one interested in time for applying for a Single License, must minimally require the release of a service through a specific release.
III. Operators in public networks of telecommunications and technologies of information and communication that require for their operation the use of frequencies, must request the License for the Use of Frequencies.
Article 38.- (SPECIFIC RELEASE). I. At expressed request from the operators and providers of services of telecommunications and technologies of information and communication, the ATT could enable through Administrative Resolution a service that had not been implemented the moment of issuing the Single License. .
II. The licenses for the services that require the use of frequencies must hold to the assignation Plans of frequencies that will be issued by the Ministry of Public Works, Housing and Service.
Article 39.- (LICENSE FOR THE USE OF FREQUENCIES). ATT will issue Licenses for the radio electric Use of Frequencies to the operators or providers of services in telecommunications and technologies of information and communication, broadcasting and private networks, always and when what is established in the National Plan of frequencies is fulfilled, existing availability and be according to the forms of issuing defined in the present Regulation.
Article 40.- (PROCEDURE FOR THE ISSUING OF LICENSES FOR THE USE OF FREQUENCIES). I. The issuing of Licenses for the Use of Frequencies destined to the services of telecommunications to the public, will be realized through public tendering or in direct form and will hold to the procedure established by the Ministry of Public Works, Housing and Service through Ministerial Resolution.
II. The Licenses for the Use of Frequencies destined to the services in broadcasting, will be issued as part of the established procedure by the Ministry of Public Works, Housing and Service through Ministerial Resolution, in the following manner:
a) In direct form for the State.
b) By project Contests for the social communitarian sector and indigenous peoples farmers, afro Bolivian and intercultural communities.
c) By public Tendering for the commercial sector.
III. The Licenses for the Use of Frequencies destined to private networks, will be issued in direct form and will be subject to the established procedure by the Ministry of Public Works, Housing and Service through Ministerial Resolution.
Article 41.- (USE OF FREQUENCY WITH EXPERIMENTAL NATURE) I. To promote the investigation and development of telecommunications through the use of new technologies, ATT will be able to issue Licenses of the Use of Frequency with experimental nature for a period of up to six (6) months non-renewable, for experiments in the radio electric spectrum consisting of international rules, always and when these experiments are in the framework of a current regulation, serve as public interest and do not cause harmful interference.
II. The applicants must comply with a presentation of the legal and technical requisites demanded by ATT according its application to each case in accordance to instructions elaborated by ATT.
III. ATT will set a payment of twelfths according to the deadline by the rights of assignation and use of frequencies DAF and DUF for the issuing of experimental licenses.
Article 42.- (USE OF FREQUENCIES OF EXCEPTIONAL NATURE). I. The diplomatic delegations can access an authorization for the use of frequencies with exceptional nature for a period of no more than a month, in case of official visits communicated to the ATT by the Ministry of Exterior Relations, in the framework of international agreements.
II. In case of declared emergency, in coordination with the National System of Reduction and Risks and Disaster and Emergency Attention-NSRRDEA, the ATT can issue licenses for the Use of Frequency without cost, for a period of no more than three months, being able to expand such period in case of a continued period of emergency.
III. Prior authorization of the ATT, the operators with License for the Use of Frequencies can carry out new locations of radio bases or other infrastructure for a limited period and established in the authorization for the delivery of services of telecommunications to the public, in specific sites where events are carried out in a public nature.
Article 43.- (PROHIBITION FOR THE USE OF FREQUENCIES WITHOUT LICENSE). No person natural or legal within the national territory of the Plurinational State of Bolivia will be able to make use of the radio electric frequencies established in the PNF, without counting previously with the corresponding license issued by the ATT, except frequencies of free use established in such plan.
CHAPTER IV
LICENSE OF A PRIVATE NETWORK AND THE ACTIVITY OF RADIO AMATEURS
Article 44.- (LICENSE OF A PRIVATE NETWORK). I. ATT will issue License for Private Networks, for the operation of networks of telecommunications and technologies of information and communication that extend outside of the property of the owner of the same and to radio amateurs, through Administrative Resolutions, prior the fulfillment of the legal and technical requisites established by the Ministry of Public Works, Housing and Services.
II. The operators of private networks and telecommunications and technologies of information and communication that require for their operation the use of radio electric frequencies, must count in a previous and additional manner with the respective License for the Use of Frequencies.
Article 45.- (ACTIVITY OF RADIO AMATEURS). The bands and frequencies assigned in the PNF for the activity of radio amateurs, can be utilized always and when they count with the proper License of Radio Amateur. These bands and frequencies cannot be assigned for exclusive use of no individual or collective person.
Article 46.- (OBLIGATIONS AND RESPONSIBILITIES). I. The radio amateurs, in function to the purposes of the service to the community, will not be able to have commercial ends nor have a place for economical benefits, having to attend the requirements of collaboration.
II. Radio amateurs will be responsible of adopting technical and security precautions to avoid interference and perturbation in the other services of telecommunications, qualifying to the sanctions established in the Regulation of Infringement and Sanctions, in case of presenting themselves.
III. Radio amateurs are strictly prohibited of interconnecting their equipments to the public networks seeking profit.
Article 47.- (CONTROL OF EMMISSIONS). ATT will control that the emissions of the stations of the radio amateurs will comply with the established technical standard for the effect.
CHAPTER V
LICENSE FOR THE SERVICES OF ADDED VALUE
Article 48.- (SERVICES OF ADDED VALUE). I. ATT will regulate the functioning, the issuing of a license, the terms and conditions of the rendering of a service; as well as the payment of the Fee of Inspection and Regulation of the services of the added value.
II. The operators or providers of public networks with a Single License, legally constituted in the Plurinational State of Bolivia, will be able to lend out services of added value directly, without requiring a License for Services of Added Value, from which they must request from ATT the corresponding release.
Article 49.- (RENDERING OF SERVICES). I. The operators or providers that render Services of Added Value, must lead an accountancy according to the system of information accounting of the ATT.
II. Operators of public networks and providers of services to the public are obligated to demand the rendering of a License for Services of Added Value or a Single License, accordingly it is corresponded, to providers of this service, in previous manner to the assignation of a line or circuit in rent or any other facility of access to a network.
Article 50.- (ENABLING AND DISABLING). I. Operators or providers of services of added value, must facilitate to their users the enabling or disabling of the services that are rendered in the same conditions.
II. Operators or providers of Services of Added Value, prior to the subscription of a user to any of the services offered, has the obligation of communicating the subscriber about the service that he will access, form of payment and form of the finalization of the subscription. If the subscription implies the continuous rendering of a service, the operator or provider must request the express acceptance of the user indicating the deadline, cost of subscription and mechanisms of complaint.
Article 51.- (SUSPENSION OF SERVICES). I. The ATT, prior technical and legal report, could order the suspension of rendering of the services of added value in the following cases:
a) When it is proved that their operation is causing damage to the correct functioning of the network of telecommunications by which it is supported.
b) When the service threatens against its users.
c) When it deals with operations or applications outside of the reach of their licenses.
II. Such suspension will maintain, until it is confirmed that the operator has satisfactorily resolved the cause that originated it.

1.1 Context
Use the words privatisation and water in the same sentence at a dinner party and you had better be prepared for a long night of heated, mostly uncompromising, debate. For some at the dinner table, “privatisation of water” echoes usurious prices and negative social outcomes, especially for the poor, who are either too vulnerable to handle price volatility of their water bills or simply cannot afford to pay for water at all. From this perspective, the suggestion that water should be treated as a commodity is criminal; the overwhelming health benefits of clean water and sanitation services coupled with the delicate
environmental balance that must be assumed in sourcing and managing water resources responsibly, strengthens the belief that the entire sector must remain in the public domain,
protected and overseen by the government. For others, the private sector is perceived to be better equipped than government to protect the water sector from misuse and inefficiency, inevitably providing more reliable and sustainable services to consumers, leading to the greater good of the public and positive social outcomes. By and large, these views fall into
two opposite camps: (a) water as an economic good best provided through unfettered markets, and (b) water as a public good guaranteed as a human right. Much of the confusion in the debate is directly related to the use of language and terminology—namely the misuse of the word “privatisation.” Privatisation is the economic process of transferring property from public ownership to private ownership through the sale of government-owned equity (shares) in nationalised industries. However, less than 1 per cent of all developing countries experimenting with privatisation ever went so far as to bring in private sector operators under a full-divestiture model (complete ownership
transfer) for water and sanitation provision. More commonly, what we observe in the developing (as well as the developed) world, is a variety of hybrid structures, mixing public and private functions; these are known as public-private-partnerships, or PPPs, and usually involve only partial ownership—or even no ownership—for the private sector. Irrespective of the type of role and the responsibility taken on by the private sector however, time and again this debate is reduced to a simplified and polarising conceptualisation of water privatisation.13
Emotionally charged misunderstandings and ideological arguments between those who support the principle of treating water as an economic good and those who cannot concede that the profit motive might be intrinsic to the efficient distribution of water, are usually at the heart of every debate related to involving the private sector in the provision of water and sanitation services. Those who believe that people should have to pay for water services may maintain that prices charged should be based on the concept of “ability to pay.” For drinking water and sewerage services, this ability is often measured by the ratio of the costs of such services relative to the overall household budget where the ratioshould generally not exceed 5 per cent. Arguably, a below market price for water can give
the impression that there is an inexhaustible availability of water and thereby sap the economic justification to curb consumption ultimately leading to the misallocation and misuse of the resource. At the same time, a price that is too high departs from the pareto optimum because it unduly limits consumption of an available resource, reduces user satisfaction and penalises the poorest segments of society.
