Unlike in an adult’s case it is not enough for the client to accept an amount that is offered to them and to then receive payment. There is an extra step involved in children’s claims and this involves judicial intervention. The child’s case needs to be put before a Judge so that he or she can confirm that the amount that has been offered by the Defendant is acceptable in the circumstances. Any settlement figure that has been agreed between the parties to that date will always be subject to the courts approval. This ensures that the amount being offered is a suitable amount based on the child’s injuries and that the litigation friend is acting in the child’s best interests. In an adults case it is possible, despite the solicitor’s advice otherwise, to accept an offer that is lower than what the claim is worth. The infant approval hearing will ensure that this does not happen in a child’s case.
