Hi all,
I am wondering if anyone could help me with answering the questions below, I could not find the answers anywhere. Please have a look and if you have any suggestions, I would be grateful.
'Ms X has been working as a medical translator since 1995. recently she produced a translation with 1 capital translation mistake, which was only discovered after 10,000 copies of the leaflet with the translation had been printed and distributed. The 10,000 copies of the leaflet had to be called back and destroyed, and a new leaflet had to be produced.
Her client, a Hospital Y, complained and held her responsible. They claimed damages worth £15,000.
Questions:
1. Can Ms X be held liable:
a) If she runs her own translation agency?
b) If she works as a full-time employee for translation company?
2. What could she have done to avoid having to pay damages?'

I think more information is needed. The explanation does not specify the two parties to the agreement - did Hospital Y contract directly with Ms. X? with a translation agency owned by Ms. X but the job was sub-contracted to someone else? with another translation agency but the job was sub-contracted to Ms. X? And questions a) and b) don't indicate who actually did the translation.
