ADDED NOTE: I would not omit it.
The company itself is the plaintiff/defendant/petitioner/respondent. It, however, can not act alone, but rather must be represented by someone, usually the highest executive committee (as Klaus correctly notes). This committee (or board) is usually represented by its chairman.
Personally, I think this all needs to be there for the sake of clarity.

Also note my use of "usually," i.e., it doesn't have to be the Vorstand; it could be someone (or something) else, which I consider another reason not to omit it.
